PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. 15A NCAC 13B .1627(d)(1)(C) Post -closure criteria states: "(1) Following closure of each MSWLF unit, the owner or operator shall conduct post -closure care. Post -closure care shall be conducted for 30 years, except as provided under Subparagraph (2) of this Paragraph, and consist of the following: " and "(C) maintaining and operating the gas monitoring system in accordance with the requirements of Rule .1626 of this Section; and " 15A NCAC 13B .1626(4) states that: "Explosive gases control. (a) Owners or operators of MSWLF units shall ensure that: (i) the concentration of explosive gases generated by the facility does not exceed 25percent of the lower explosive limit in on -site facility structures, excluding gas control or recovery system components; and (ii) the concentration of explosive gases does not exceed the lower explosive limit at the facility property boundary. " Eighteen of the landfill gas monitoring events conducted between October 18, 2018 and March 24, 2023, showed that LFG-1 had methane exceedances of the regulatory limit of 5% LEL for property boundary monitoring. The Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section exceedances ranged from 6.2% to 60.5% methane by volume. Continue to work with Elizabeth Werner, Permitting Hydrogeologist with the Solid Waste Section on required actions to address methane exceedances. Compliance will be achieved when methane levels are maintained within the regulatory limit. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility operated as a municipal solid waste landfill and ceased receiving waste in 1994. 2. The entrance to the facility from Dalton Road is secured with a gate to prevent unauthorized access. 3. Edge of waste markers were in place and visible along the perimeter of the landfill. 4. The landfill had good vegetative cover. The landfill cap was not inspected for any erosion issues, depressions and leachate seeps due to the tall established vegetative cover. Facility staff stated that mowing of the landfill cap is scheduled within the next couple of months. Upon completion, an additional inspection will be performed of the landfill. 5. During the inspection a few small trees were observed on the cap. Mr. Lambert stated the trees would be removed when the landfill is mowed. 6. The trees that were observed growing on the cap over waste during the January 31, 2017, have been removed in accordance with the approved Post -Closure Maintenance Plan - Revision 01. 7. During the inspection conducted on January 31, 2017, it was discovered that a Gas Remediation Plan had not been submitted to the Section. On May 30, 2017, S&ME submitted to the Section a Landfill Gas Monitoring Plan for the closed MSWLF and the closed C&D landfill. The Section approved the plan on July 11, 2017. 8. Quarterly methane monitoring reports were reviewed for sampling events conducted between October 2017 to March 2023. Exceedances were noted for LGF-1 on: October 18, 2018, October 22, 2018, November 7, 2018, November 19, 2018, November 27, 2018, December 13, 2018, January 8, 2019, February 25, 2019, April 1, 2019, August 16, 2019, November 15, 2019, January 28, 2020, April 3, 2020, September 16, 2020, February 24, 2021, June 8, 2022, December 20, 2022, and March 24, 2023. Please see the Observed Violations section of this report. 9. On October 18, 2018, an exceedance of the lower explosive limit (LEL) for methane (5% by volume) was first detected at monitoring location, LFG-1, which is located adjacent to the property boundary. S&ME notified NCDEQ in writing of the findings and presented a plan for the collection of additional landfill gas readings. 10. On May 15, 2019, S&ME submitted to the Section a Landfill Gas Passive Vent Installation Work Plan. 11. On November 13, 2019, three Passive Landfill Gas Vents (PLFGV) wells were installed to relieve/reduce the subsurface migration of methane gas from the landfill toward the property boundary. 12. On February 24, 2023, an additional monitoring point, LFG-5 was installed on the adjacent firing range property to evaluate the migration of landfill gas. LFG-5 was installed approximately 104 feet to the southeast of LFG-1. 13. Facility stated that the 2" Quarter 2023 gas monitoring will be conducted in early June. 14. Semi-annual ground water monitoring reports were reviewed for sampling events conducted between October 2017 to April 2022. 15. A random inspection of ground water and landfill gas monitoring wells was conducted.
