PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Section Staff David Powell attempted to inspect Snowhill LCID 26L but a fence and locked gate were installed and block access. Last visit in 2021 by Section staff was to meet with Barnhill Contracting representatives to provide technical assistance on closure of the facility and to consider purchasing/renewing permit for operating. It is understood that sale did not occur. However, site essentially still needs to go through closure requirements. For meeting this requirement, documentation of borings confirming proper cover with engineer certification should be provided. All buffers being met with proper sloping 3:1 on all slopes. Attempts have been made to contact Frank McDonald through emails and phone calls. Owners of landfill should contact David powell to allow access and perform a more through inspection and discuss corrective actions onsite. 2. Any overgrown vegetation should be mowed, and trees larger than 6 inches should be cut, with the root ball removed and proper soil replaced and compacted. Less than 6 inches should be cut down and ensure they don’t return. Ensure all ruts and settled areas over the waste are graded to ensure water is not ponding on top of waste. Edge of Waste (EOW) markers shall be installed. They should be visible from one to the other, suggest tall white PVC pipe. 3. Also, property lines and edge of waste should be permanently marked and visible to ensure that the buffer of 100’ is maintained. A previous inspection, it was noted that it appeared that the buffer “appears to average eighty (80) feet from edge of waste to the property line on the west slope.” Disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface water runoff in a controlled manner. 4. If this facility wishes to pursue getting a permit for operating in the future, then there are issues that will need to be addressed before operations can commence. A sign must be posted at the entrance in accordance to the rule. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 5. As the site is mowed, exposed waste may be discovered. Cover all waste along the toe of the slopes and grade the area in accordance to your approved plans to ensure that water flows away from the waste. Ensure that grading activities do not reduce separation to the seasonal high groundwater table. Side slopes should not exceed a 3:1 ratio. All exposed waste must be covered and provisions for a ground cover sufficient to restrain erosion. 6. Current access road, if maintained properly, should continue to meet rule requirement. New rule siting requirements are that an access road around the EOW be installed and maintained. 15A NCAC 13B .0564 (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. 15A NCAC 13B .0566 (7) - Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles. 7.
