Teresa Bradford, NCDEQ – Solid Waste Section STATUS OF PERMIT: A Life of Site Permit Approval to Construct Phases 5 and 6, Permit Approval to Operate Phases 1-4 (Permit No. 6204-MSWLF-1995) and a Yard Waste Collection Facility (6204-TP-2011) was issued to Montgomery County (Owner) and Republic Services of North Carolina, LLC (Operator) a wholly owned subsidiary of Republic Services, Inc. d/b/a Uwharrie Regional Landfill on June 22, 2022 (FID 1683060). The expiration date for Permit No. 6204-MSWLF-1995 is December 11, 2055. The expiration date for Permit No. 6204-TP-2011 is May 14, 2025. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. 15A North Carolina Administrative Code 13B .1626(2)(b) states, “Except as provided in Sub-item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors.” B. 15A North Carolina Administrative Code 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 Permit to Operate No. 6204-MSWLF-1995, Attachment 1, Part I, General Permit Condition Number 6 states, “Construction and operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Should the approved plan and the rules conflict, the Solid Waste Management Rules shall take precedence unless specifically addressed by permit condition. Failure to comply may result in compliance action or permit revocation.” • The approved Operation Plan (Doc. ID. No. 1676381) is included in the List of Documents for the Approved Plan. Section IV(A) Landfilling/Operations of the approved Operation Plan states in part, “Per North Carolina State Regulations, a daily cover of 6" of compacted soil or an alternative daily cover must be placed on top of the daily landfill operation to protect the landfilled waste from exposure to rain and becoming windborne, and to prevent rodent and insect propagation or infestation. During the inspection, inadequate cover was observed on the north side slope of Cell 8 and the south side slope of Cell 12. However, during the inspection, additional soil cover was observed being added to the area on Cell 12. Therefore, BFI Waste Systems of North America, LLC, a wholly owned subsidiary of Republic Services, Inc., is in violation of 15A NCAC 13B .1626(2)(b) and 15A NCAC 13B .0203(d). To achieve compliance, all waste must be covered with a minimum of six inches of earthen material at the conclusion of each operating day. Bradford) ADDITIONAL COMMENTS 1. The facility consists of a MSWLF, yard waste treatment and processing area, scrap tire collection area, white goods area and a drop-off convenience area for residential waste. 2. The facility is permitted to receive non-hazardous solid waste generated within the boundary of the State of North Carolina consistent with the Franchise Agreement (DIN 26331) and the amendment (FID 1404913), expect where prohibited by North Carolina General Statutes Article 9 of Chapter 130A and the 15A NCAC 13B Rules. 3. Proper signage was observed at the entrance of the facility. 4. A gate was located at the entrance to the facility to prevent unauthorized access. Operations Inspection of the MSWLF (6204-MSWLF-1995): 5. The facility currently accepts approximately 2,200 tons of waste each operating day. 6. Waste was being disposed of in Cell 10/12 during the inspection. 7. The facility utilizes two tippers. 8. The active working face was well controlled. 9. No unacceptable waste was observed. 10. Windblown waste was well controlled. 11. The facility utilizes Posi-Shell, petroleum contaminated soil, foundry sand and fabric tarps as alternative cover material. 12. Edge of waste markers were being maintained. 13. Access roads were well maintained. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. A visual inspection of the two 260,000-gallon leachate tanks found that both tanks appeared to be maintained properly. The leachate is discharged into the Town of Troy sanitary sewer system or pump and hauled to a plant in Winston Salem, North Carolina. 15. Leachate recirculation is not being conducted at this time. 16. The facility is currently constructing Cell 15A. Cell 15A will be constructed in two parts, the lower end of approximately 5 acres and the upper end of approximately 6.3 acres. Operations Inspection of the Tire Collection Area: 17. Tires were being collected into multiple enclosed trailers. 18. The tire collection area was well managed. Operations Inspection of the White Goods Collection Area: 19. White goods that contain Chlorofluorocarbons were being stored in an upright condition. 20. The white goods collection area was well managed. Operations Inspection of the Yard Waste Area: 21. The area consisted of land clearing debris and wooden pallets. 22. No unacceptable material was observed. 23. The ground material is being used on the landfill and not given to the public. Records Review: 24. The permit and operations plan were reviewed. 25. Random load inspection records were reviewed. The facility conducts three random load inspections per day. 26. Special waste determination and asbestos protocols were reviewed. A random sampling of waste determination records was reviewed. 27. Alternative daily cover records were reviewed (petroleum contaminated soil monthly acceptance log). 28. Quarterly methane monitoring was being conducted as required. Records for sampling events performed on 3/30/22, 6/23/22, 9/22/22 and 12/29/22 were reviewed. No exceedances above applicable standards were detected. 29. Semiannual groundwater, surface water and leachate monitoring were verified via the Division Document Database. 30. All leachate lines were remote video camera inspected and jet cleaned in June 2020. 31. 451,307 gallons of leachate was discharged into the Town of Troy sanitary sewer system in February 2023. 561,615 gallons of leachate was pumped and hauled to a HOH in Winston Salem, North Carolina in February 2023. 32.
