POST-CLOSURE CARE REQUIREMENTS FOR THE CLOSED MSWLF PHASE 1 on June 8, 2020; Expires December 29, 2057. (In accordance with 130A-294 (a2) this permit is for the life-of-site. Life-of-site ends when the facility reaches its final permitted elevations or by December 29, 2057.) PURPOSE OF SITE VISIT: Partial Inspection – CDLF / Closed MSW - Landfill Reclamation Pilot Project (Bale Fill Project) Startup FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 13 STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA ADDITIONAL COMMENTS 1. David Powell, and other inspectors with the Section, met with Cumberland County Solid Waste (CCSW) staff to view the Landfill Reclamation Pilot Project (Bale Fill Project) startup at the Closed MSW, under the CDLF. The landfills were visited briefly during setup and repairs of Bale fill project equipment. Ann St landfill was in good condition during visit. Good job. 2. Working face in Phase 6 and was not too large during inspection. Additional soil was stockpiled near the working face for cover. West of working face. Side slope covered and looking good. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Last visit, the older cells atop the CDLF/Closed MSW needed some waste covered/removed and grass established. Although Section staff didn’t visit this specific area on top, the area was viewed from riding its perimeter. The side slopes around landfill looked well maintained, appropriately sloped and vegetated. A few seep repair areas were visible but they were mostly on the MSW and very small. Closed MSW north side. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 6 of 13 4. The slopes of the Closed MSW were well maintained. EOW markers we visible. On the northwest corner, a loaded vehicle overturned when dumping its soil for repairing ruts in access road. No one was hurt and the vehicle was up righted soon after. A dozer arrived shortly after to spread out soil that was dumped. Northwest corner of Closed MSW. Bale fill project behind and right of this view. 5. Windblown was not an issue for the CDLF, although some windblown was noted in other areas of the Ann St. landfill. Good job. 6. Division of Air Quality (DAQ) Permit was expired during last visit in November 2022. Contact DAQ staff for any possible corrective actions for expired permit. Follow through with permit if not done so already. 7. Ground water and methane wells that were visible along the perimeter roadway seemed to be locked, with lids, and in good condition. These will be inspected more in depth in the comprehensive inspection. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 7 of 13 8. Concrete crushing and staging area. Remember 75% must be utilized within one calendar year of acceptance. Concrete should be crushed and stockpiled or used and not left then it can be become disposal and not recycling. Refer to G.S. § 130A-309.05. Regulated wastes; certain exclusions. Area has had waste pushed toward an unnamed tributary. Concrete waste that’s older and pushed away from main area of crushing, should be removed, crushed and have unapproved waste disposed at an appropriate site for that waste type. It was brought to the Sections attention, that during onsite evaluations for this area to be considered for a new Transfer Station, Construction and Demolition wastes were discovered under this crushing site, and to the west, on the other side of the unnamed tributary (to Cross Creek then to Cape fear River). The waste under the center of the concrete crushing area had waste discovered down to 17 ft. The limitations of the wastes depths and area are unknown currently. An ambient monitoring sample, with Division of Water Resources (DWR), was also mentioned, regarding increased levels of Ammonia in the surface waters of the unnamed tributary next to this site. Cumberland County is in the process of evaluating the C and D waste and the Ammonia levels. It was mentioned by County staff that another source in this area to be considered for increased Ammonia levels, is an older sewer force main in this approximate location, and close to the C and D waste in the area. Possible further excavations and wells are needed to determine the source of the Ammonia and to assist with corrective action planning. Ms. Bader and Mr. Smith described plans to add constructed wetlands to stormwater structures onsite around the landfills and this would be implemented very soon. Section staff informed Ms. Bader that waste would need to be removed, unapproved waste taken to appropriate landfill for that waste type. Large metal, and some small plastic was visible in the concrete onsite currently and should be removed. In addition, the County needs to communicate with DWR and Section Permitting before actions are taken. Please keep me informed of this situation as it progresses. A Corrective Action Plan should be submitted, with realistic time frames, for evaluating and addressing these issues within 60 days from receipt of this inspection report. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 9 of 13 9. Closed MSW - Landfill Reclamation Pilot Project (Bale Fill Project) Startup today. Section staff met onsite with County staff to witness the startup and initial operation of the excavation of older waste from the Closed MSW. The excavated material is then put into a screen to remove waste, recyclables, unapproved wastes and from soil. Before leaving, onsite discussions were made to consider running a large screen of approximately 2 inches in series with a 1 inch, finer screen, to separate finer wastes and recover more soil. Please keep the Section informed on progress and if any issues or change in operations. Please document waste recovery and operations of this “demo”. Communicate with Section permitting before altering any onsite operation to ensure there is no approvals that are needed before those new operations can begin. A follow-up inspection will be conducted by Solid Waste Section Staff. Communicate with DWM Section permitting, DEMLR for stormwater and DWR on issues at concrete area. A Corrective Action Plan should be submitted, with realistic time frames, for evaluating and addressing these issues within 60 days from receipt of this inspection report.
