PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NONE OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0542(f)(2) states “Except as provided in Subparagraph (4) of this Paragraph, the owners and operators of all C&DLF units shall cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and no less than once weekly. Cover shall be placed at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors. A notation of the date and time of the cover placement shall be recorded in the operating record as specified in Paragraph (n) of this Rule.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 The sloped area at/near the working face was observed to have no cover placed for some time, according to facility staff and cover records, 7 loads of cover were placed the week prior to the inspection, however none had been applied to the slope. Further, multiple areas of exposed waste were observed outside of the immediate area of the working face along the NE slope of the remainder of the landfill. Waste had migrated through wind and rain down the slope and into previously closed and grassed areas of the landfill. Additionally, the lack of sufficient cover is allowing leachate to be shed down the slope towards the base of the landfill. 2. 15A NCAC 13B .0542(g) states “Windblown waste requirements. Methods such as fencing, and diking shall be provided within the area to confine solid waste that is subject to be blown by the wind. At the conclusion of each operating day, all windblown material resulting from the operation shall be collected and disposed of by the owner or operator.” Although landfill staff have been working to collect windblown waste, multiple areas along the facing landfill slopes (facing the scale house) and as noted in #1 above below the working face were observed. 3. 15A NCAC 13B .0542(l)(4) states in part “Leachate shall be contained on-site or treated prior to discharge” 15A NCAC 13B .0203(d) states “By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Part III, # 36 of the approved permit states: “a. Leachate and observed leachate seeps must be properly managed on site using best management practices to prevent leachate from leaving the limits of waste disposal areas and to minimize the potential for reoccurrence. b. Routine inspections for leachate seeps must be conducted. When a leachate seep is discovered, the permittee must notify the Section and implement corrective action including environmental media sampling as described in the approved plan.” An area of approximately 150 ft in horizontal length along the slope directly adjacent (to the north) of the working face has multiple leachate seeps that have been occurring for an extended period of time. Leachate was observed to have migrated nearly to the toe of the landfill slope and the stormwater ditch. At least one of the areas has been wet for a period of time that has allowed cattail type vegetation to present itself that has been mowed down by facility staff. During that maintenance or during routine landfill inspections as noted in #36(b) above, staff should have observed and made attempts to correct these matters in accordance with the rules and permit. ADDITIONAL COMMENTS The facility is a construction and demolition (C&D) debris landfill. The Life-of-Site Permit for Continued Operation of Phases 1 through 6 was issued November 1, 2019. Life-of-site ends when the facility reaches its final permitted elevations or by December 31, 2057. Large Type I Solid Waste Compost facility (1007) and LCID (10E) also located onsite. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility is permitted to receive C&D waste, inert debris, asphalt, and land-clearing debris generated within Brunswick County. 2. The facility is fenced and is secured by a locking gate when it is not open for operation. 3. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 4. Personnel are onsite during operating hours. The C&D landfill is open to accept waste from 7:30 am until 5:00 pm Monday through Friday and 7:30 am until 3:00 pm on Saturday. The C&D debris landfill is normally closed on Sunday’s and select County holidays. 5. A perimeter road has been established around the entire footprint of the landfill. The perimeter road is being well maintained. Staff training records were reviewed: 6. Permit, operations plan, and site plan were readily accessible. 8. Digital photos were taken during the inspection. CDLF 9. Landfill is currently being used minimally to save airspace. Most waste is being managed through the transfer station. 10. Corrective actions are necessary to bring the landfill into compliance. A Notice of Violation letter will accompany this report and will outline the necessary actions. LCID 11. Signs are posted and contain all required information. 12. Only inert debris is accepted, which is crushed for reuse. There was no unacceptable waste(s) observed in this area. Staff noted that they had ceased allowing one business to bring countertop material to this area and instead it was being disposed at either the landfill or transfer station. Compost Facility 13. The facility is a Large, Type 1 Solid Waste Compost Facility. 14. Permit To Operate issued November 1, 2019. Permit expires November 1, 2029. 15. Compost processed at Type 1 facilities shall be maintained at or above 55 degrees Celsius (131 degrees F) for 3 days and aerated to maintain elevated temperatures. 16. Waste storage and compost windrows are maintained a minimum of twenty-five feet between windrows/waste piles and ditches/swales. 17. There is at least a 25 foot access path around the site for fire control vehicles. 18. All setbacks are in place. 19. The facility has a substantial backlog of unprocessed material; however, they have recently acquired a new, larger grinder and are able to process at a faster rate. Any paper or plastic in the unprocessed material should be screened and removed prior to grinding. 20. No windblown waste was observed in this during the inspection attributed to the YW operations. As noted in the Transfer Station report, any trucks being temporarily store adjacent to the LCID and Compost areas should be monitored for leaks and any litter associated with those trucks should be collected daily and taken back to the Transfer Station for proper disposal.
