Life of Site Permit issued March 13, 2019 and will expire May 29, 2068. PURPOSE OF SITE VISIT: On-Site Meeting with County and CEI Staff and Partial Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: See previous November 4, 2022 Inspection Report. Past noted violations listed below have been resolved. A. 15A NCAC 13B .0405 (a) (10) RESOLVED: Several temporary employees were on site during this visit to assist in collecting windblown waste. Windblown waste throughout the facility grounds, including within previously noted areas, has been greatly reduced. Waste previously observed in the fire hose pits, behind the push walls, and found underneath FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 the plastic sheeting and within the rip rap on the eastern side of the transfer station building has been removed and disposed of. County staff submitted a plan for soil removal and testing of impacted areas, sampling was conducted, and the sample results were reviewed and approved by Section staff. B. 15A NCAC 13B .0405 (b) RESOLVED: Leachate drains in the transfer trailer loading bay were observed to be generally free of waste and dirt accumulation. Facility staff have implemented morning and mid-day cleanings of the transfer trailer loading bays to reduce waste buildup, as well as mid-day cleanings of the tipping floor pad. Sludge created from accumulated leachate and dirt continues to build up but is generally being contained to the tipping floor apron. Facility staff are encouraged to do a better job keeping leachate inside the transfer station building, or further violations could ensue. C. 15A NCAC 13B .0405 (c) RESOLVED: Wake County staff sent an official email to all licensed haulers on 9/26/22 emphasizing that NC General Statutes and Wake County ordinances require solid waste collection vehicles and containers to be constructed, operated, and maintained to be leak resistant. Starting 10/1/22, violators are being reported to Wake County staff for follow-up investigation. Facility staff are now actively directing queued collection vehicles into and out of the transfer station building to increase efficiency, reduce wait times, and minimize leakage. Staff are also providing containment troughs as needed to collection vehicles waiting to enter the TS. A sand pile has been procured by CEI to be used for egregious leakage/spillage. D. 15A NCAC 13B .0104 SOLID WASTE STORAGE RESOLVED: Leaking City of Raleigh plastic rolling garbage bins have been removed from the dirt area adjacent to the access road. Soil in affected areas has been removed and samples have been submitted to a lab for testing. Two separate Leachate Release and Soil Sampling Reports from Wake County and City of Raleigh were received by the SWS and approved by Jaclynne Drummond on 11/16/2022 and 1/3/2023, respectively. ADDITIONAL COMMENTS 1. Section staff met with Wake County and CEI staff to discuss the progress made on resolving the Notice of Violation(s) issued on 9/20/22 as well as recommendations made in the 9/8/22, 9/29/22, and 11/4/2022 inspection reports. 2. Sludge produced from a combination of leachate and dirt on the tipping floor is an ongoing issue and continues to be carried on loader tires outside the transfer station building and onto the apron. Contrary to the previous inspection, due to a combination of staff actively directing collection vehicles and loaders being operated with increased care, facility staff are now generally containing the sludge to the apron. However, multiple soil areas adjacent to the apron were again observed to contain remnants of sludge and waste. Ensure measures are taken to prevent leachate from escaping the tipping floor to create sludge. Continually applying clean soil on top of impacted soil is not a sufficient solution. A berm may need to be installed along the edge of the tipping floor to prevent leachate from escaping the transfer station, and/or a berm or curb installed along the margin of the driveway to prevent leachate and sludge from contacting the adjacent soil. Any soils impacted by sludge should be removed immediately and disposed of properly. 3. As noted in previous inspection reports, waste escaping the transfer trailers and accumulating within the loading bays, then escaping the loading bays through the chain link fencing constitutes an ongoing issue. Mr. Baldwin previously discussed options such as installing sheet metal or plexiglass along the exterior fencing to prevent waste from escaping the loading bays. At the time of this inspection, CEI had received a cost estimate from a vendor to install a plexiglass barrier in these areas. It continues to be recommended that measures are implemented to prevent waste from accumulating within the transfer trailer loading bays and escaping through the fencing. 4. As noted in previous inspections, waste and mud accumulation was observed along the entrance to the transfer The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 trailer loading bay and had migrated off the road to the adjacent ground. Waste and wash-down water accumulation was also observed on the adjacent ground outside the containment system at the exit of the transfer trailer loading bay. The current configuration of the trailer loading bay entry and exit points is not effective in containing waste and leachate within the collection system. Mr. Hammonds recommended a temporary soil berm be constructed in these areas to direct leachate and waste back into the containment system until a permanent solution can be implemented/constructed. It is recommended that a permanent solution such as concrete curbing be installed along the entry and exit points as well as along the margins of the driveways to prevent leachate and waste from escaping the containment system. 5. After this inspection, on the evening of 1/12, Ms. Morse emailed pictures to Section staff showing the areas of concern noted in #3 and #4 had been cleaned and a small temporary soil berm installed adjacent to the jersey barriers outside of the trailer loading bay exit. These pictures have been included in this inspection report. 6. Facility staff should continue to monitor the soils adjacent to and within operating, loading, and trailer staging areas. Any soils impacted by leachate escaping containment should be removed immediately. 7. A large hole filled with stormwater adjacent to the access road remains from where soil was excavated by the City of Raleigh. This area should be backfilled with clean soil and graded to achieve positive drainage of stormwater. 8. The stone riprap placed adjacent to either side of the WTS continues to collect and hold waste that must be removed and disposed of daily. Mr. Baldwin and County/City staff will discuss the necessity of the stone and the option of removing it and establishing vegetation in these areas. 9. Mr. Baldwin stated that the vendor contracted to replace the tipping floor and make other various repairs to the facility will begin construction within the next 6 months. 10. Temporary measures must be installed/implemented to ensure areas/items identified as needing repair or replacement in the Transfer Station Assessment Report function as designed and maintain operational compliance until permanent repairs are completed. 11.
