Issued April 10, 2019 and Expires 12/15/2055. PURPOSE OF SITE VISIT: Follow-up Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Corrective Actions are in process. OBSERVED VIOLATIONS: Pending Corrective Actions Taken due to non-compliance issues stated on this inspection report. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS: 1. This meeting scheduled to address concerns noted on the January 03, 2023, inspection report (and other past reports) that was sent to Mr. David Cotton, Hertford Co. Manager, Ms. Ashley J. Ward, Hertford Co. Solid Waste Manager and Mr. Andrew Hammonds, NCDEQ-DWM-FOB-Eastern Area Supervisor. 2. The leachate collection has been non-operational due to the failure of the back wall. The leachate collection system must be repaired right away or other measures installed to manage leachate at this site. It may be necessary to stop accepting waste during rain events if you cannot properly collect leachate at this facility. 3. When the back wall of the tipping floor and fuel/oil containment area is being replaced, Hertford County should consider having a 1 block high lip installed on the side by the compactor and the other side to prevent leachate and waste from leaving the tipping floor footprint. If not managed, this could cause a Notice of violation. 4. There was water observed ponding in areas adjacent to the tipping pad with waste visible in the water. One of the areas appears to be the result of the font end loader going in and out. These areas must be filled with soil and graded to prevent ponding water and the potential generation and accumulation of leachate outside of the collection system. These areas should be seeded and mulched to establish vegetation once repaired. 5. The Yard Waste needs to be stored and managed as the rules for a Small Type 1 Compost Facility (15A NCAC 13B .1402 GENERAL PROVISIONS FOR SOLID WASTE COMPOST FACILITIES, 15A NCAC 13B .1404 SITING/DESIGN REQUIREMENTS FOR SOLID WASTE COMPOST FACILITIES and 15A NCAC 13B .1406 OPERATIONAL REQUIREMENTS FOR SOLID WASTE COMPOST FACILITIES. 6. The Yard Waste area access road at the back must be made of all weather-construction so incoming traffic can get up the hill at the entrance and around the area to be able to unload and the area to be managed properly and to allow for positive drainage of water away from the waste. The road on top of the closed MSWLF has rock and is in good condition. 7. The above Compost rules referenced on this report are attached to the email sent with this report. 8. The storage of YW near the office was temporary. The waste must be moved to the YW area or removed from the site for proper disposal. The Yard Waste area MUST come into compliance to avoid a Notice of Violation. 9. There was quite a bit of waste (smalls) coming of the tipping floor onto the ground along the side of the compactor that MUST be picked up daily like all windblown trash. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please make sure that ALL staff is aware that all waste inside the footprint of this Transfer Station Unit must be cleaned up daily. Refer back to your Transfer Station Operation Rules, Permit and Operations plan that has this information as well. 11. The other issue that was observed during this inspection was that there were not enough empty containers to handle the incoming waste. Remember that NO waste must be left on the tipping floor after working hours. 12. All open top containers must be covered when left onsite. 13. It may help to discuss this issue with your contract hauler (GFL) to ensure that this doesn’t cause a non-compliance issue as well. 14. ALL the above was discussed while on-site with Ashley Ward. 15. Corrective measures are necessary as a result of this inspection. Measures to bring this site into compliance should be completed within 30 days receipt of this report. Failure to do so may result in notice of violations and enforcement actions.
