STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .1402 (g) -UNRESOLVED OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 ADDITIONAL COMMENTS 1. Mr. Powell inspected YWN, to check on progress and conditions of the site. Mr. Powell didn’t meet with any Town staff but did meet with Mr. Phil McCallum whom owns McCallum Construction and whom the Town has hired to remove the waste onsite. He was working during inspection. Much work has been done but there is more to go. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. The YWN rules were emailed to Mr. Townsend on 2/12/2022 and 3/10/2022. 3. Upon investigation, it was apparent much work had been done to removing waste from the notification. Some waste still remains and should be removed as conditions allow. Hand picking remaining waste onsite is needed as well to clean up the finished areas of the notification. Be sure and remove all MSW and older YW but do not excavate or disturb soil cap of Pre-Regulatory Landfill. If unsure of this depth then a professional should be hired to evaluate the site and determine the depth and a plan to remove the waste. Still some MSW wastes needing removal, this can be done by walking and picking up by hand then taking to approved disposal site. Remainder of the Notification has had most of waste removed. Illegal site IS782204 behind wastewater treatment plant had waste removed and photos/weight ticket documentation sent to Section on 8/28/2022 and 8/31/2022. New waste has been brought onto a cleared area behind the wastewater treatment plant. Original waste was removed but someone dumped on the Town since its removal. Please be sure and add “No Dumping” signs and/or control access to this entire site. All waste needs removal and documentation of proper disposal. Please remove new waste. A large pile of tires is also still present between YWN and the WWTP, where illegal site is located. Discussions after visit between, Mr. Powell and Mr. Townsend, consisted of the Town has been working with County on taking a large pile to them for disposal to Carolina Tire. Be sure and get documentation of proper disposal and remove ASAP. 6. Mr. Townsend requested some additional time for compliance, weather has been holding up work onsite. He also indicated they were working on signs for no dumping at this site and notifying all whom had access to prevent future dumping. Mr. Powell sent Mr. Townsend and Mr. Filli link to Temporary Disaster Debris Site information on the NCDEQ website. Town of Rowland wishes to have a TDDS site once violations are resolved. The Town should review the documents provided via the link, narrow down some sites that meet the requirements and submit what’s necessary and Mr. Powell can work with the Town in approving a site for future needs. 7. Corrective measures are necessary as result of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff within about 30 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions. Further time can be given, but progress and good communication with Mr. Powell is needed moving forward on progress.
