PURPOSE OF SITE VISIT: Complaint
STATUS OF PAST NOTED VIOLATIONS:
NONE
OBSERVED VIOLATIONS:
1. 15 NCAC 13B .1402(g)(3) states that small Type 1 facilties must provide, “notification to the Division prior
to operation and an annual basis.”
Frank Horne Construction Co. Inc. #2 is in violation of 15A NCAC 13B .1402(g)(3)by failing to notify the
Solid Waste Section annually as required. The last record of annual notification is dated October 16, 2017.
To achieve compliance, the City of Eden must submit Yard Waste Notification to the Solid Waste Section
on or before February 20, 2023 for review and approval. Additional guidance about submitting Yard

ADDITIONAL COMMENTS
1. This facility is a Type 1 Yard Waste Notification. Facility accepts land clearing debris consisting of whole trees, tree
limbs, branches, and untreated wood. Facility also accepts yard trash consisting of grass, leaves, brush, shrubs, and
other yard trimmings.
2. Land clearing debris and yard trash is burned and ashes are screened and used to make topsoil. Facility has DAQ Air
Permit #0909$G05 for the use of one forced air curtain incinerator.
3. The facility can receive the aforementioned wastes for processing and storage in volumes not greater than 6,000 cubic
yards material onsite at any given time, including finished product. The area of the waste processing and storage
cannot exceed two acres.
4. No offsite sedimentation was observed.
5. An interior roadway has been made of all-weather construction and is being maintained in good condition.
6. There is at least a 25 foot access path around the site for fire control vehicles.
7. All setbacks are in place.
8. No standing water was observed during the inspection
9. Facility stockpiles concrete onsite for future use. Per G.S. 130A-309.5 (c) (1) Seventy-five percent (75%), by
weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing
January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year.
10. Stockpiled materials are being maintained in reasonably sized piles with adequate fire breaks.
11. Facility stockpiles concrete onsite for future use. Per G.S. 130A-309.5 (c) (1) Seventy-five percent (75%), by
weight or volume, of the recovered material stored at a facility at the beginning of a calendar year commencing
January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year.
12. Stockpiled materials are being maintained in reasonably sized piles with adequate fire breaks.
13. Unacceptable waste consisting of metal and treated lumber were noted during the inspection in the concrete
pile. Unacceptable waste needs to be removed and properly disposed of at a facility permitted by the Section
to accept the waste type. Documentation will be required to indicate that the waste has been disposed of

14. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be
completed within 30 days receipt of this report. The SWS will conduct a follow-up inspection in 30 days to
ensure issues noted in this inspection report have been addressed
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
