CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 3416T-TRANSFER-, ATTACHMENT 3, PART VI, Transfer Station/Treatment and Processing Unit Condition #7(a) states, “The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily.” On September 27, 2022, Republic Services of North Carolina, LLC was in violation of 15A NCAC 13B .0203(d) for failing to maintain the loading bay in a clean and sanitary condition. Waste was built up along the loading bay wall and waste had escaped the transfer station through holes in the wall. Temporary patches that were previously added to the outside wall of the loading bay to prevent waste from escaping the facility had failed. During the December 21, 2022 inspection the transfer station wall panels along the loading bay had been FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 replaced except that a section at the loading bay entrance was missing. A buildup of waste was observed inside the loading bay with waste having escaped though the opening where the wall panel was missing. A follow-up compliance inspection will be conducted to confirm compliance with 15A NCAC 13B .0203(d). OBSERVED VIOLATIONS: B. OBSERVED VIOLATION: 15A NCAC 13B .0405(a)(10) states, in part, “Windblown waste: Site staff shall conduct daily inspections for windblown waste on the site property. Windblown litter from site operations discovered during the daily inspections or observed on adjacent properties shall be picked up and containerized for disposal by the end of each operating day, unless the landowner of the adjacent property denies access to site staff.” Republic Services of North Carolina, LLC was in violation of 15A NCAC 13B .0405(a)(10) for failing to pick up and containerize windblown litter from site operations discovered during the daily inspections and containerized by the end of each operating day. During the inspection, windblow litter was observed throughout the entire facility and was observed along the outside the perimeter fence line along the Northwestern side of the facility. OBSERVED VIOLATION: 15A NCAC 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 3416T-TRANSFER-, ATTACHMENT 3, PART VI, Transfer Station/Treatment and Processing Unit Condition #7(b) states in part “waste must only be deposited on a “tipping floor” or directly into a transfer container.” Republic Services of North Carolina, LLC is in violation of 15A NCAC 13B .0203(d) for allowing waste to be deposited outside of the tipping floor. View of the exit of the loading bay where waste had accumulated. A follow-up compliance inspection will be conducted to confirm compliance with 15A NCAC 13B .0203(d). ADDITIONAL COMMENTS 1. The purpose of this inspection was to follow up on corrective actions and temporary measures enacted to address existing violations. (See Status of Past Noted Violations section of this report for additional information.) 2. During the inspection the transfer station was observed missing a wall panel for the transfer station loading bay area walls. This allowed waste to escape the transfer station building. Mr. Fernandez stated that the contractors would be returning sometime later that week to complete the installation of the last wall panel. The loading bay area was observed to have an abundant accumulation of waste with more waste observed at the exit of the loading bay. Mr. Fernandez provided pictures of the loading bay area cleaned of waste at the end of the day. On January 6, 2023, Frank Perrotto provided pictures showing the installation of the last wall panel. 3. During the inspection a transport trailer was observed dragging waste from the loading bay and deposited further out into the facility. Ensure that the loading bay area is cleaned as needed to maintain a clean and sanitary condition. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Windblown material was observed throughout the property with windblown observed past the perimeter fence on the northwestern side of the facility. Ensure that all windblown waste is picked up and containerized for disposal by the end of each operating day. 5. Two transfer trailers were observed during the inspection stagged north of the transfer station building. One trailer that did not contain waste had hole located on the bottom of the trailer. Mr. Fernandez stated that the trailer was not being used and waiting for repairs.
