Operations Plan — Approved November 24, 2015 (DIN 25327) PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA OepaN W Emironm l puelily Solid Waste Section OBSERVED VIOLATIONS: A. 15A NCAC 13B .1406(19)(a) states: "Facilities permitted as Large Type 1, Large Type 2, all Type 3, and all Type 4 shall have an operator, supervisor, or manager trained in accordance with the requirements in G.S. 130A-309.25. No less than one trained operator, supervisor, or manager meeting the requirements of this Sub -item shall be onsite during the facility's operating hours or available at a phone number provided in the facility permit. (i) Training in accordance with G.S. 130A-309.25(c) shall be required every five years. (ii) Persons who have achieved and maintain compost operator certification by the US Composting Council Certification Commission or equivalent shall be considered as having met the training requirements in G.S. 130A-309.25 for the permitted facility. " Wallace Farm Inc. is in violation of 15A NCAC 13B .1406(19)(a) in that the Davie County Compost Facility does not have a trained operator, supervisor, or manager on site during the facility operating hours or available at a phone number provided in the facility permit that meets the requirements of 15A NCAC 13B .1406(19)(a). The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance to the facility. 2. The facility actively maintains internal access roads due to recent and ongoing precipitation. 3. It appears windrows were being maintained at/near the approved size as stated in the approved operations plan. Mr. Carter stated that facility staff continue to cover windrows with carbonaceous materials and mature compost to prevent odors. 4. During the inspection, facility staff were moving compost to the screener in preparation for bagging. 5. No objectionable odors were detected at the facility or off -site. 6. During the inspection of the earthen berm and small catch basin area an opening in the berm was observed. This area was pointed out to Mr. Carter, and he stated Mr. Wallace had installed the third storm water pond. Facility staff were advised to close the earthen berm and continue to pump out the basin to prevent a leachate release. Mr. Carter provided photograph documentation the opening in the earthen berm has been closed. During the inspection observed that stormwater pond number 3 had been constructed. Mr. Carter stated Mr. Wallace constructed the stormwater pond in June. Ensure the stormwater pond was constructed in accordance with the erosion control plan approved by DEMLR. View of stormwater pond number 3 located along the northern property boundary. Photo taken by Kim Sue 1 l/16/2022. Records 8. A copy of the current permit and operations plan are maintained in the office. 9. Composite sampling records were reviewed. The most recent report was September 28, 2022. The facility tests every six months. 10. Temperature logs dated October 2021 to November 14, 2022 were reviewed. Temperatures appeared to be maintained at or above the required temperature. 11. Feedstock tonnage records were reviewed. The facility has received and composted 8,324.60 tons from July 1, 2021 to December 31, 2021 and 45,387.94 tons from January 1, 2022 to November 14, 2022.
