On December 1, 2021, the Solid Waste Section issued a letter to Cabarrus County approving the operations of Phase 4. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The facility consists of a closed MSWLF, a closed CDLF on top of a closed MSWLF, an active CDLF, a yard waste area, a compost area and a convenience area for residential waste and recycling. 2. On January 1, 2022, a revised operations plan to include the Type 1 Compost Operation was submitted to be included in the Substantial Amendment and Phase 4 Permit to Construct. 3. On January 13, 2021, in an e-mail to Donna Wilson, Engineering Project Manager, with the Solid Waste Section, CDM Smith Inc, on behalf of Cabarrus County (County), informed Ms. Wilson that the County was no longer moving forward with the Type 3 compost facility. 4. The landfill is permitted to receive solid waste generated within the following North Carolina counties: Cabarrus and counties contiguous to Cabarrus County (Iredell, Rowan, Stanly, Union and Mecklenburg). 5. Proper signage was observed at the entrance of the facility. 6. The facility is secured by a locked gate at the facility entrance. 7. Access roads are of all-weather construction. Operation Inspection of the CDLF (1302-CDLF-2006): 8. The facility was working in Phase 4 of the CDLF. 9. Facility receives approximately 55 tons of C&D waste per operational day. 10. The working face was small and well controlled. 11. No unacceptable waste was observed. 12. Windblown litter was well controlled. 13. Good vegetative cover was observed on inactive areas. 14. Edge of waste markers were being maintained. Inspection of the Closed MSWLF (1302-MSWLF-) and the Closed CDLF over the Closed Unit 3 (1302-CDLF-1998): 15. Good stand of vegetation is being maintained. 16. Edge of waste markers were being maintained. 17. Continue to remove woody vegetation as needed. Operation Inspection of the Yard Waste Treatment and Processing Area and Compost Area (1302-COMPOST-2013): 18. Only Type 1 waste is accepted. 19. No unacceptable waste was observed. Operation Inspection of the Scrap Tire Area: 20. Tires are collected in a covered trailer and being stored properly. Operation Inspection of the White Good Area: 21. White goods containing Freon are separated from other metals and stored in an upright manner. Records Review: 22. Reviewed the permit, operations plan, weekly inspection records that includes the soil cover log, scrap tire certification forms, training records, quarterly methane monitoring records, semi-annual groundwater and surface water monitoring, compost temperatures and random inspection records (1 per week). 23. Certified Manager of Landfill Operations Certification: • Randall Foster (expires 3/19/2024) The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
