Life of Site Permit issued March 13, 2019 and will expire May 29, 2068. PURPOSE OF SITE VISIT: On-Site Meeting with County and City Staff and Partial Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: See previous September 29, 2022 Inspection Report. Past noted violations listed below are in the process of being resolved. A. 15A NCAC 13B .0405 (a) (10) RESOLVED: Several temporary employees were on site during this visit to assist in collecting windblown waste. Windblown waste throughout the facility grounds, including within previously noted areas, has been FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 greatly reduced. Waste previously observed in the fire hose pits, behind the push walls, and found underneath the plastic sheeting and within the rip rap on the eastern side of the transfer station building has been removed and disposed of. County staff submitted a plan for soil removal and testing of impacted areas, sampling was conducted, and the sample results were reviewed and approved by Section staff. B. 15A NCAC 13B .0405 (b) PARTIALLY RESOLVED: Leachate drains in the transfer trailer loading bay were observed to be generally free of waste and dirt accumulation. The sludge coating the access road exiting the TS building has been cleaned. However, during this inspection, sludge originating from the tipping floor was actively being carried on loader tires and pushed off the tipping floor apron, across the driveway and onto the adjacent soil. C. 15A NCAC 13B .0405 (c) RESOLVED: Wake County staff sent an official email to all licensed haulers on 9/26/22 emphasizing that NC General Statutes and Wake County ordinances require solid waste collection vehicles and containers to be constructed, operated, and maintained to be leak resistant. Starting 10/1/22, violators are being reported to Wake County staff for follow-up investigation. Wake County and CEI staff are discussing a plan to queue and hold all incoming waste collection vehicles at the base of the access road to help prevent leakage while waiting stationary on the hill. A sand pile has been procured by CEI to be used for egregious leakage/spillage. D. 15A NCAC 13B .0104 SOLID WASTE STORAGE PARTIALLY RESOLVED: Leaking City of Raleigh plastic rolling garbage bins have been removed from the dirt area adjacent to the access road. Soil in affected areas has been removed and samples have been submitted to a lab for testing. Lab results remain pending. ADDITIONAL COMMENTS 1. Section staff met with Wake County, City of Raleigh, and CEI staff to discuss the progress made on resolving the Notice of Violation(s) issued on 9/20/22 as well as recommendations made in the 9/8/22 and 9/29/22 inspection reports. 2. Windblown waste observed in previous inspections in the employee parking area, along the exterior facility fencing, within the fire hose pits, and behind and on top of the push walls had been cleaned up. Good job! 3. Scrap metal waste adjacent to the tipping floor apron and driveway noted in the 9/8/22 inspection report had been removed and disposed of. Good job! 4. During this inspection, collection vehicles were observed leaving the tipping floor area with their rear containers in an upright position and the tailgate open, allowing leachate to drain from the rear of the vehicles onto the driveway and outside the leachate collection system. Sludge produced from a combination of leachate and dirt on the tipping floor was then being carried on loader tires outside the WTS and pushed off the driveway and onto the adjacent soil. Ensure measures are taken to prevent leachate from being dumped outside the collection system, such as having facility personnel hold collection vehicles on the tipping floor until loads have been fully dumped and containers are back in level position. A berm may need to be installed along the edge of the tipping floor to prevent leachate from escaping the transfer station, and/or a berm or curb installed along the margin of the driveway to prevent leachate and sludge from contacting the adjacent soil. Impacted soils should be removed immediately and disposed of properly. 5. Windblown waste that had accumulated along the southern shoulder of the access road in front of the City of Raleigh rolling bin storage buildings had been removed and the grass on the southern side of the access road had been mowed. Good job! 6. As noted in previous inspection reports, waste escaping the transfer trailers and accumulating within the loading bays, then escaping the loading bays through the chain link fencing constitutes an ongoing issue. Mr. Baldwin discussed options such as installing sheet metal or plexiglass along the exterior fencing to prevent waste from The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. It is recommended that measures are implemented to prevent waste from accumulating within the transfer trailer loading bays and escaping through the fencing. 7. Stained soil was observed at the rear of a transfer trailer in the transfer trailer staging area. Black flies had accumulated in this area. Ms. Morse stated that containment troughs had been ordered and facility personnel conduct trailer checks every day. The Section commends Ms. Morse on taking these actions and recommends that any stained soils be removed and disposed of as soon as they are observed. 8. Leaking trailers should be repaired as necessary or removed from service until adequately repaired. 9. Temporary measures should be installed/implemented to ensure areas/items identified as needing repair or replacement in the Transfer Station Assessment Report function as designed and maintain operational compliance until permanent repairs are completed. 10.
