Permit to Operate will expire April 17, 2025. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTICE OF VIOLATIONS: 3505-MWP A. 15A NCAC 13B .0101 (28), "'Inert debris waste' means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead -based paint." CORRECTIVE ACTIONS IN PROGRESS: The countertop material is still being uncovered in the inert debris stockpile. Mr. Hill stated that they were still removing the countertop material from the roadway and inert debris stockpile. Mr. Hill stated that the countertop material is being disposed of at the landfill. The countertop materials have been treated with sealants and have adhesives on the back and do not meet the definition of an inert debris as defined in 15A NCAC 13B .0101 (28). Continue to remove the countertop material from the inert debris stockpile and roadways. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." and 15A NCAC 13B .0301 (6)(D), "Buffer Requirements ... surrounded by an unused and cleared area of no less than 25 feet to allow access for fire or emergency response vehicles." The facility is in the process of installing an access roadway around the LCID; however, the roadway was constructed with the comingled ground countertop and concrete material. The facility is in the process of removing the countertop material from the roadway. Continue to establish and maintain the access road around all areas for fire and emergency response vehicles. 2. A water truck is located at the property and is used to control dust emissions at the facility. 3. The previously identified mulch piles have been removed from the facility. A stockpile of land clearing waste was identified to be clean and of manageable size during this inspection. 4. The previously identified pile of shingles had been removed from the facility. The area has also been graded to shed water. 5. Minimal windblown waste was observed during this inspection. Continue to ensure that windblown is removed prior to the end of the day. 6. Minimal exposed waste was observed along the side slopes. Mr. Hill stated that additional soil would be brought in to provide extra cover and bring the side slopes to the three horizontal to one vertical ratio. Mr. Hill also stated that LCID would be closed out and certified by an engineer. Ensure that the LCID is closed in accordance with 15A NCAC 13B .0567 (b). 7. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 8.
