Duncan Parker, L&D Landfill – 401 Sand Co. Josh Byrd, L&D Landfill - 401 Sand Co. STATUS OF PERMIT: Permit issued September 3, 2020; Expires September 3, 2025. PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0566 (1) - The site shall only accept those solid wastes that it is permitted to receive. (RESOLVED) Upon inspection, it was discovered that five large loads of C and D waste were accepted on the working face. This waste consisted of wood flooring, painted wood, sheetrock, metal wiring, painted block, misc. metal and plastic. Construction and Demolition waste is not acceptable waste type at a Land Clearing and Inert Debris landfill. Mr. Powell informed Mr. Duncan Parker, Mr. Lindsey and Mr. Byrd, and it is believed this waste was brought in while they were away from working face during lunch break, especially given the speed of truck entering and dumping. Mr. Parker had the waste removed from the working fast the following day and taken to Hoke County Transfer Station, weight tickets were provided 11/6/2022. This violation is resolved. Good job. David Powell with the Section conducted a follow up inspection of the LCID for corrective actions from previous inspection. 2. Upon arrival, the working face has been altered to function better. Good job. There are many vehicles dumping every minute. Operators are covering and bringing soil almost constantly to manage working face. Waste is inside EOW markers and being compacted at lower level to bring it up to high elevation to meet previous working face area. Western end of working face and entrance The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The side slopes were covered, compacted, and sloped well. EOW markers were visible. Silt fence still present. Access around entire footprint of LCID is available, except an area which has silt fence. Operators should consult with DEMLR representatives and check plans before altering anything to change this area for adding access through this structure. It is suggested to leave it as is and add all weather road access around it as well. Western side need better road access as well. 15A NCAC 13B .0564 (7) - The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. Western side slope and entrance to top of south side of LCID. Access around perimeter needs to be maintained open for use for firefighting and inspection vehicles. While there weren’t any unapproved wastes discovered in the working face, above the working face there was five large loads of Construction and Demolition wastes stockpiled awaiting disposal into LCID. It is believed that while Mr. Parker was on lunch break, some unapproved loads were taken and dumped onsite at the opportune time. These wastes consisted of painted block, sheet rock, treated wood flooring, plastics and metal. These wastes are not acceptable at a LCID and should be removed immediately to the appropriate disposal site for this waste type. Mr. Powell informed Mr. Lindsey, Mr. Duncan, and Mr. Byrd, once returning to their office. Mr. Duncan assured that they would be removed the following day. The wastes were removed the following day and weight tickets provided to Mr. Powell on 11/6/2022. It is recommended that anyone working at the landfill be familiar with the permit, acceptable waste types and 15A NCAC 13B .0566 OPERATIONAL REQUIREMENTS FOR LCIDLFS. 6. Corrective measures are needed and should be completed within 30 days receipt of this inspection. All weather road around the perimeter needs attention.
