Box 1719 Kill Devil Hills, NC 27948 PARTICIPANTS: Lynn Lindsey – Solid Waste Management Supervisor John College – NCDEQ-DWM-SWS-FOB STATUS OF PERMIT: Notified site – No permit required. PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS: 01 - This was an unannounced site inspection. 02 - Required signage at entrance. 03 - Site is not open to the public. Only the Town of Kill Devil Hills has access to use this site. 04 - The gate was locked for security. 05 - The road was in good condition. 06 - Composted material looked good. 07 - Compost is being removed as to make room for new vegetative debris. 08 - Temperature records were emailed to John College on 8/25/2021 from Lynn Lindsey and were reviewed. 09 - The compost in in one windrow. Un- Processed Storage pile is one long and wide pile (windrow). 10 - The Un-Processed pile (windrow) is getting large. Fire lane around this pile except in one small area. Need to open that area up ASAP. 11 - Please remember that a Small Type 1 facility can only have 6000 cu/yds processed and un-processed at any time. May be getting really close to that. 12 - All finished and raw material appears to be inside of the Notified area of < 2 acres. 13 - It appears that facility staff has not been pulling out the non-conforming waste. Treated and plywood, particle board and Lowes Paper Leaf Bags were noted and discussed with Lynn during this inspection. 14 -The 15A NCAC 13B .1400 rules do not allow for bags to be processed into compost on these type facilities. Only vegetative materials are allowed. 15 - 15A NCAC 13B .1402 GENERAL PROVISIONS FOR SOLID WASTE COMPOST FACILITIES: (e) Solid waste compost facilities shall be classified based on the types and amounts of materials to be composted as follows: (1) Type 1 facilities may receive yard and garden waste, silvicultural waste, and untreated and unpainted wood waste. NO Bags allowed. If bags are processed, this will become a non-compliance issue; ie: Notice of Violation. 16 - Digital pictures were taken during this facility inspection. Remove before grinding. • Fire lanes and small area of lane blockage in need of pushing back onto the pile to ensure fire lane is available.
