STATUS OF PAST NOTED VIOLATIONS: NA NOTICE OF VIOLATION: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 ADDITIONAL COMMENTS: 1. David Powell met with Mr. Stacey McQuage onsite for a requested Pre-Operational Inspection. Site has a Temporary Disaster Debris Site, and now a Compost and Treatment and Processing permit. This site has become a Large Type 1 permitted facility. The city wishes to keep the DS83-006 for emergencies. DS83-006 not being used and is not activated at this time. Mr. McQuage and Mr. Powell discussed map and approved areas. 8303-COMPOST-2021 2. Preoperational conditions for the City of Laurinburg’s 8303-Compost-2021 Permit have been met for Area 2. Area 3 is for future expansion and isn’t prepared at this time and cannot be used until meets approved plans/permit conditions. Smith and Gardner Inc.’s’ Mike Brinchek submitted the Engineers Certification 10/21/2022 to the Section. 3. Site was clear of waste. Edge of Waste markers (EOW) installed for new permit and seemed to be in appropriate placement according to map submitted. Be sure all waste storage, operations are inside of the approved area (Area 2 – 2.3 acres/4,000 CY) and marked with EOW markers, and outside of the buffers also indicated on the 10/21/2022 engineer certification letter map submitted to the Section. Be sure all permits/maps onsite at the T and P (ACI) and Compost have been updated with the new and correct information for operators onsite. Be mindful of the size and volume allowed in this area. 4. Stormwater pond (SWP) needs vegetation established to restrain erosion and to maintain its proper construction. Consult DEMLR Mike Lawyer/Consultant on what to utilize in short term until warm season and establishing permanent grasses etc. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Currently the approved permit states in Attachment 3, Part VI, 32, “Ash resulting from operation of the ACI shall be mixed with the finished compost products at the designated area.” In deviation from approved operations should be approved by Section Permitting and be reflected in the current operations plan before it is put into effect. If the city wishes to pursue this pathway for ash to be land applied, then they should contact Chester Cobb, with the Environmental Compliance Branch, on how to be approved. His contact information is 919-707-8283 or chester.cobb@ncdenr.gov. “ An additional ash storage area is being built and used. It is currently under construction and not complete at this time. Based upon discussion onsite with Mr. McQuage, there is a delay upon sending ash in short term to landfill. They must wait several weeks to ensure fire coals are cold before allowing the waste to be accepted at landfill. All approved plans and maps should be updated and submitted to the Section to reflect this addition. Now Compost area is approved to be used the ash con be incorporated, once ensured the coals are cold, into the compost. Otherwise this waste must go to an MSWLF for disposal. This additional area will also allow for a longer storage time for coals going cold before they are mixed with compost and potentially cause a fire. Ash storage shed near entrance road. Waste in ACI area needs better separating into windrows and proper construction as defined and approved in permit. Separation prevents fire jumping from one windrow to another in event it catches fire. Permit Attachment 3, Part VI (18) - The storage of feedstock/wastes and/or treated/processed products and compost shall meet the following conditions: a. Windrows for active composting at least 21 days after the feedstocks are received at the designated area shall be limited to the dimensions described below unless otherwise approved by a local Fire Marshal. i) 30 feet in width and 25 feet in height if the windrow is turning with a wheel loader. Or ii) 8-16 feet in width and 5-7 feet in height if the windrow is turning with a compost turner. c. - A 25-foot minimum distance is required and constantly maintained between feedstock stockpiles or compost areas and swales or berms to allow for adequate access of firefighting equipment, as per Rule 15A NCAC 13B .1404(a)(8) and the approved plan (FID 1619886). 7. Roadway was of all-weather construction at the time. Site is behind several city fenced facilities and is secured by gate. 8. Mr. Powell received copies of Letter of Approval for Industrial Storm Water Permit and a Stormwater NPDES Certificate of Coverage/Permit NCG240027 from DEMLR. OTHER 9. YWN-83-002 / DS83-005 was visited as well and seems to be near capacity. Temporary Disaster Debris Site (TDDS) is not active and waste onsite is waste from Yard Waste Notification (YWN). Now Compost permit has had pre-operation inspection it can take pressure off the YWN. 10. N0656 CLOSED NCLID was looked at as well. DS83-007 was clean and clear of waste. Site is not activated at this time. 11. Communicate with Division of Air Quality on meeting the requirements for ACI operation and sampling requirements. Communicate with DEMLR on any additional requirements, technical assistance on vegetation for SWP.
