David Powell, NC DEQ STATUS OF PERMIT: Site Closed June 30, 2008 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. The facility has been closed since 2008. A Post Closure Plan was approved in August of 2009. Mr. Powell emailed Mr. McClary a copy of this plan previously. Site is gated with signage and behind the NLCIDLF. Mr. Harris rode Mr. Powell around perimeter of the limits of landfill during inspection and the top was inspected as well. 2. EOW markers present and visible. Landfill needs more frequent mowing. Mr. McClary had stated earlier that a contractor was going to visit soon to mow all facilities. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 3. Erosion rills on north side of slope needing repair. Replace soil and slope correctly and reestablish vegetation. 4. Records emailed by Mr. Kip McClary, included, December 2021 Annual GW monitoring report, which was reviewed. Some sample results resulted in higher concentrations than the NC2L standard. Please work with Environmental Compliance Branch Head, Perry Sugg, with Solid Waste Section at (919) 707 – 8258 or perry.sugg@ncdenr.gov, if not already doing so. 5. Corrective measures are necessary as result of this inspection and should be completed within 30 days’ receipt of this inspection. A follow up compliance inspection will be conducted by Solid Waste Section Staff shortly after that time. Failure to meet the conditions for compliance may result in further Compliance Actions.
