The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
Mr. Blaylock had requested a meeting with Solid Waste Section staff to discuss the requirements for the proper closure
of the LCID. Mr. Russ informed Mr. Blaylock that the LCID would need to be closed in accordance with 15A NCAC
13B .0567. Mr. Blaylock was informed that the LCID would need to be properly surveyed with edge of waste markers
installed. Mr. Blaylock would also need to either use a soil auger or dig test pits to confirm that the disposal area has been
covered with a minimum of one foot of soil cover. Mr. Russ also told Mr. Blaylock that he would be required to provide
a map depicting the locations of the soil cover confirmation points. An engineer would need to certify that the closure of
the LCID has been completed.
As per the post closure care requirements, Mr. Blaylock will be required to maintain the cap, including making repairs to
the cover as needed to correct issues such as subsidence and erosion. The vegetative cover of the cap would also need to
be maintained to ensure that trees and other woody vegetation do not become established on the cap. Mr. Blaylock would
also need to keep a record of any maintenance that has been completed at the facility. The post closure care shall be
conducted for 10 years.
1. The facility is a land clearing and inert debris (LCID) landfill.
2. The facility is properly secured with a chain and bollards.
3. The facility has proper signage.
4. The LCID waste appears to have been properly covered. Mr. Blaylock will need to confirm that the waste has
been properly covered with a minimum of one foot of soil.
5. The facility was mainly vegetated. The vegetation had become overgrown with some woody vegetation along the
side slopes. During this inspection, Ms. Thompson stated to Mr. Blaylock that the LCID should be mown, and
the woody vegetation removed to allow for proper inspection.
6. A pile of concrete and asphalt was identified to be west of the office trailer on -site. Ms. Thompson stated to Mr.
Blaylock that the concrete and asphalt would need to be either buried in the LCID or taken to another permitted
facility for disposal. Mr. Blaylock stated that he would take the waste to another facility due to the fact that
vegetation has already been established at his facility.
7. Digital pictures were taken during the inspection.
8. Please provide the closure documentation to the Section once closure has been completed.
