HomeMy WebLinkAbout9241_NOV_20221014 October 14, 2022 CERTIFIED MAIL 70092250000410844024 RETURN RECEIPT REQUESTED Josh Daher, Area President Meridian Waste North Carolina, LLC 424 Warehouse Drive Raleigh, NC 27610 SUBJECT: Notice of Violation Compliance Inspection Report – Morrisville Transfer Station Morrisville Transfer Station, LLC - Operator Permit Id Number: 9241-TRANSFER-2020 Wake County Dear Mr. Daher: On October 12, 2022, Jason Watkins, Field Operations Branch Head for the Solid Waste Section conducted an after-hours inspection of the Morrisville Transfer Station to determine if waste is being properly disposed of at the end of each days operations in accordance with North Carolina solid waste statutes and rules. The following violations are documented on the attached facility inspection report: A. 15A NCAC 13B .0203(d) “By receiving solid waste at a permitted facility, the permittee shall be considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit. Attachment 3 of the approved permit under Condition Part VI (7) states: a. The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily in accordance with the approved Operational Plan. b. Waste must only be deposited on a "tipping floor" or directly into a transfer container. Waste must not be stored on the "tipping floor" after operating hours. B. 15A NCAC 13B .0405(a)(11) states in part “Unless otherwise stated in the site permit, all waste shall be removed from the tipping floor, the truck loading bays, and from behind push walls by the end of each day of operation and disposed of in accordance with this Subchapter Meridian Waste North Carolina, LLC and Morrisville Transfer Station, LLC are in violation of the aforementioned rules and permit conditions for failure to remove and properly disposed of C&D waste at the end of each working day. Waste in excess of several days of the accepted volume were observed from outside the facility extending beyond the tipping floor and at its peak being at/above the adjacent Transfer Station rooftop. Estimation of several thousand tons of waste remained onsite. Morrisville Transfer Station Notice of Violation Page 2 of 2 October 14, 2022 Based upon the foregoing, Waste Management of Carolinas, Inc. shall come into compliance by with all requirements of the regulations in 15A NCAC 13B .0203(b), .0405(a)(11) and the facility’s permit by completing the following within the deadlines noted below: 1. Immediately upon receipt of this notice, cease acceptance of all waste at this facility until the Solid Waste Section confirms all stockpiled waste is removed and properly disposed of at a permitted landfill. 2. Remove all stockpiled waste to a permitted landfill within 7 calendar days of receipt of this Notice. Documentation to include individual tickets for each load of waste taken to the landfill shall be submitted to the Section within 2 calendar days of disposal. The violations listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, revocation of permits, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Please keep me informed of your progress in this matter. Solid Waste Section staff may conduct a follow- up inspection to verify completion of the requirements of this Notice of Violation.
