RESOLVED: 15A NCAC 13B .0405(a)(11) states, in part, “All waste shall be removed from the tipping floor, the truck loading bays, and from behind push walls by the end of each day of operation and disposed of in accordance with this Subchapter.” Republic Services of North Carolina, LLC was found to be in violation of 15A NCAC 13B .0405(a)(11) for failing to remove all waste from the tipping floor and the loading bay at the end of each day of operation. During the previous inspection Republic Services of North Carolina, LLC was found to be violation of 15A NCAC 13B .0405(a)(11) for failing to remove all waste from the tipping floor and loading bay at the end of each day. After the inspection facility personnel provided photo’s clearly showing that all waste had been removed from the tipping floor and loading bay in accordance with State ordinances. RESOLVED: 15A NCAC 13B .0405(a)(10) states, in part, “Windblown litter from site operations discovered during the daily inspections or observed on adjacent properties shall be picked up and containerized for disposal by the end of each operating day…” During the previous inspection Republic Services of North Carolina, LLC was found to be violation of 15A NCAC 13B .0405(a)(10) for failing to pick up and containerize windblown litter from the operation site. After the inspection facility personnel provided photo’s clearly showing that the windblown material had been picked up and containerized per State ordinances. OBSERVED VIOLATIONS: 1. OBSERVED VIOLATION: 15A NCAC 13B .0203(d) states, “By receiving solid waste at a permitted facility, the permittee shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 3416T-TRANSFER-, ATTACHMENT 3, PART VI, Transfer Station/Treatment and Processing Unit Condition #7(a) states, “The tipping floor and transfer trailer loading area must be maintained in a clean, sanitary condition at all times and must be cleaned at least daily.” Republic Services of North Carolina, LLC is in violation of 15A NCAC 13B .0203(d) for failing to maintain the loading bay in a clean and sanitary condition. escape of waste from the loading bay of the facility. Temporary patches that were previously added to the outside wall of the loading bay to prevent waste from escaping the facility have failed and allowed waste to escape the loading bay To achieve compliance Republic Services of Nort Carolina, LLC shall take steps to ensure that the loading bay is maintained in a clean and sanitary condition. Additionally, ensure that all waste stays within the tipping floor and loading bay areas of the transfer station and that any waste that escapes is picked up at the end of every day. ADDITIONAL COMMENTS 1. All photos included in this report were taken by Robert Pike on September 27, 2022, during the inspection. 2. The facility is a MSW transfer station permitted to receive non-hazardous waste. The facility is owned by Republic Services. 3. The facility operating hours are 4:00 a.m. to 7: p.m. Monday through Friday and 4:00 a.m. through 4:00 p. m Saturday. Records Review: 4. A copy of the Permit to Operate and the current approved Operation Plan were available for review onsite. 5. Transfer trailer inspection records were reviewed for July, August and September 2021 and found to be complete. Log sheets note any specific issues found with each individual trailer as well as any comments needed to clarify repairs needed. Any trailers found to be in need of repair are taken out of service and sent for repair. 6. Monthly facility inspection records were reviewed from January 26, 2022, through September 19, 2022. All records were complete. 7. Cleaning records were reviewed for the transfer station. Monthly cleaning records for the tipping floor and The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Records were reviewed for November 2021 through September 2022. Ms. Hernandez stated that the entire transfer station is pressure washed on a quarterly basis. 8. All liquids from the transfer station drain into an oil/water separator that is emptied as needed. Ms. Hernandez provided records indicating that Safety-Kleen Systems, Inc. empties the leachate in the oil/water separator on a regular basis. 9. The FAR for the FY 2021-22 was reviewed and 137,537.30 tons of solid waste was received at the facility. 10. Initial waste screening occurs at the scale house by the scale house operator. Random waste screenings are performed on the tipping floor where facility staff direct loads to be placed and then inspected. Waste screening records were reviewed through September 26, 2022. The facility is meeting the required 5% of the average daily waste tonnage. 11. Training records indicated that the following staff have current NCSWANA Transfer Station Operations Specialist certifications: • Justin Jones – expires September 22, 2024 • Joe Prestandrea – expires April 5, 2023 • Lamard Crawford – expires June 13, 2023 • Sandra Lucas – expires July 15, 2024 Facility Inspection: 12. Proper Signage was observed at the facility entrance. 13. The site is secured by a chain link fence hat surrounds the perimeter. The facility has two entrances secured by locking gates. 14. Facility roadways are paved and of all weather construction. The roadways were observed to be in need of repair with potholes being observed on the roadway located on the sides f the facility as well as the approach to the tipping floor. Ms. Hernandez stated that repairs to the facility roadways are scheduled to occur in 2023. 15. Traffic is managed by the scale house operator while the loader operator directs trucks to the unloading location. 16. The tipping floor appeared to be in good condition with no major damage or cracks. 17. The inside walls of the transfer station were free from waste. 18. The tipping floor is designed so that leachate flow is directed to an opening in the back of the tipping floor that drains down to the loading bay. The loading bay floor is sloped to direct leachate into the recessed floor drains located under the scales. Accumulated trash was observed on the floor of the loading bay. Facility staff stated that waste is removed from the loading bay floor at the end of each day. 19. The exterior wall of the loading bay had been previously repaired with sheet metal patches. During this inspection, many of the patches were observed to have pulled loose from the wall, allowing waste to escape the building. Please see the Observed Violations section of this report. 20. Damage to the outside walls of the transfer station was observed on the back if the building and on the northwestern side of the facility. The damage on the back side of the facility had been temporally repaired and had no visible waste escaping. 21. The site is graded so that all liquid flows to the northwestern side of the property, where curbing directs it to inlets that drains to the sewer system. 22. Empty transfer trailers were staged in the parking/storage area behind the transfer station building. Each trailer was inspected and found to be in good condition, with no holes or leaks visible. 23. Some windblown trash was observed in the staging area for the empty transfer trailers. Ensure that all windblown material is collected daily. 24. Fire extinguishers are located on site for fire control.
