The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. The facility serves as a yard waste treatment and processing facility for Forsyth County. The facility is permitted to receive land clearing debris, yard waste, and untreated, unpainted wood wastes including wooden pallets, dimensional lumber, and engineered wood products. 2. The city of Winston-Salem contracts with Wallace Farms, Inc. to manage operations at the facility. Wallace Farms provides a site supervisor who serves as the facility’s operations manager. 3. Copies of the facility Permit to Operate and Operations Plan are kept on file in the scale house and are available upon request. 4. The facility annual report for FY 2021-22 indicated that a total of 24,298.63 tons of waste was received. Mr. Dively provided the tonnage during the current fiscal year by email following the inspection. Monthly tonnage was reported as follows: July 2022 – 2,352.84 tons, August 2022 – 2,315.99 tons. 5. No composting takes place on site. 6. The site is surrounded by a chain link fence and is secured by locking gates that prevent access to the site. 7. Proper signage was observed at the facility gate. 8. The facility was observed to be clean and well maintained. 9. Roadways are paved and in good condition. The are of broken and missing asphalt noted in previous inspections are still present. Mr. Dively stated that stone is applied to the roadways as needed and that the area was slated to be repaved in the future. 10. No ponding water was observed in and around the waste stockpiles. 11. All loads are weighed and recorded upon entering and exiting the facility. Preliminary waste screening takes place at the scale house where the operator uses the camera system to inspect the loads prior to directing them to the appropriate tipping location. 12. No grinding was taken place on site during the time of inspection. Mr. Dively stated that the equipment was currently at another facility. 13. The wood waste stockpiled was observed and no unacceptable material was observed. 14. Untreated wood waste is kept in a separate pile from the yard waste/wood waste stockpile. During the inspection a painted pallet was observed to be in the untreated wood waste. Mr. Dively and Mr. Tilley removed the unacceptable waste from the pile as required by the approved Operations Plan. 15. The processed wood waste is stockpiled on the southern end of the site. The stockpiles were observed to follow the size restriction found in the current Operation Plan. 16. The facility appeared to be incompliance with the required buffer setbacks.
