PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: Non-conforming waste The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS: 01 – This Yard Waste Notified site was YWN98-001. 02 – Renewal information was not sent in for past several years by Envirolink staff that managed this facility. 03 – A new application was submitted and given this NEW ID. YWN98-007. 04 – From Last Inspection Report: The site is currently under major renovation (Land grading, screening yard waste of bags, windrowing and grinding of large waste) to be in compliance. This Inspection: The land grading and screening has stopped. No materials have been ground and windrows are just piles. Sorting out bags of leafs has been taking place, but all bagged leafs are just piled up with no bag removal. These bags will breakdown and then there will be plastic into the compost. This is an unacceptable practice. Bags are in need of removal. 05 – There was non-conforming waste noted during this inspection. This site can only receive vegetative waste. 06 – From Last Inspection Report: The facility is lacking Security (Locking gates or cables) at 2 entrances. This Inspection: No attempt has been made to secure this site. 07 – From Last Inspection Report: Need to add signage. Emergency Contact number (911) (event of a fire), Facility number and operation’s contact number. This Inspection: No attempt to add signage. 08 – John College - Division of Waste Management (DWM) met with Lauren Garcia - Division of Energy, Mineral and Land Resources (DEMLR) and Travis Clarke – Envirolink on this site inspection to discuss above issues DWM noted and issues DEMLR had with this site lacking a Sedimentation and Erosion Control Plan. 09 – Mr. Clarke is new to this site. All items above were discussed with Mr. Clarke. 10 – Before the inspection concluded, Mr. Clarke and staff had both entrances secured with locking cables. Signage will be placed ASAP. 11 – MS. Garcia discussed the Sedimentation and Erosion Control Plan with Mr. Clarke. 12 – Mr. Clarke to discuss options for this site with upper management of Envirolink. 13 – Several more follow up inspections to be conducted until ALL issues resolved and to discuss the options Envirolink will be taking to stay in compliance with the rules for this site. 14 – Digital pictures were taken during this Inspection with some attached to this report.
