STATUS OF PERMIT: Permit To Operate (PTO) issued March 17, 2021 PTO expiration date October 08, 2025 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On September 08, 2022 Chuck Kirchner met with Mark Doggett to conduct an inspection of the Heritage Farm Properties LLC LCID Landfill located on Scalesville Road in Summerfield, Guilford County. 1. The facility is a land clearing and inert debris (LCID) landfill owned by Heritage Farm Properties LLC. 2. The facility is not open to the public. 3. The landfill is used solely by the Doggett Construction Company, Inc. 4. The Doggett Construction Company, Inc. personnel operate the LCID landfill. 5. This permit covers Phase I which is filled and Area 1 and Area 2 of Phase II. Area 1 is constructed and active and Area 2 is to be constructed and approved by this permit. 6. Permit Condition, Attachment II, Part V, Number 3, sections ‘a’ through ‘f’ shall be completed prior to accepting permitted waste in Phase II – Area 2. 7. The facility permit, site plan, and operations plan were discussed. 8. The facility is permitted to receive waste generated within Forsyth, Guilford and Rockingham Counties. 9. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 10. The landfill is open but was not in operation during this inspection. 11. The working face was small and compact. 12. Additional LCID is currently being added to the lower side of Phase II, Area 1 to bring the slope up in this area. This area will be covered and stabilized as soon as the desired lift is completed in this area according to Mr. Doggett. 13. Good grass cover observed on most covered areas of the LCID landfill. 14. Per 15A NCAC 13B .0566(3), “All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.” 15. Per 15A NCAC 13B .0566(4), “Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community.” 16. The Heritage Farm LCID landfill maintains an ample supply of cover material. 17. Excavation, grading, and fill material side slopes observed did not exceed three to one (3:1). 18. Permanent edge of waste markers using a silt fence post with a white sign observed on site. Continue to maintain EOW markers as needed. 19. The facility stockpiles concrete and used asphalt to be crushed. The crushed material is primary used by the Doggett Construction Company, Inc. 20. Incidental waste received at the facility, such as tires and C&D waste, is staged in an area away from the landfill. Mr. Doggett stated that this material is then sorted and disposed of at a proper permitted facility. 21. The facility annual report (FAR) was received by the SWS, dated July 18, 2022. Estimated facility throughput per week for July 2021 through June 2022 is 570 yd3. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Erosion control measures are installed and there was no indication of erosion or runoff off site. 23. Baffles in the sediment basins have recently been replaced. 24. Continue to maintain erosion control measures as needed. 25. Open burning is not permitted at this facility. 26. Fires must be reported to the Regional Environmental Senior Specialist within twenty-four (24) hours of the occurrence with a written notification to be submitted within fifteen (15) calendar days of the occurrence. 27. Access roads are of all-weather construction. 28. The facility is secured by a locked gate. 29. The facility has a proper sign.
