The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell with the Section conducted an inspection of the recently permitted LCIDLF on 9/7/2022. Facility still has signage and gates for limiting access and all-weather road to facility. New rules in 2021 require the LCID to have a perimeter road, made of all-weather construction, for access. Access road should be installed around the perimeter of the approved LCID. This was discussed onsite, and according to Mr. Byrd, not hard to expand road access. However, be sure not to alter anything onsite that conflicts with any approved plans or drawings, such as altering erosion control measures, without getting permission from the appropriate Division with DEQ before any changes and get approval, if it’s necessary.
15A NCAC 13B .0564 (7) - The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment.

2. Upon arrival, it was apparent the working face was at max size of one acre and waste was being dumped off the ledge of previous waste covered and not so deeply mined areas into the lower areas. The current method of dumping, pushing over edge stretches out the working face and makes it very difficult to cover, compact and slope 3:1 according to rule and it is wasting space that could be used for additional disposal in the future. It is harder for the operator to control traffic and keep up with covering as well. It was discussed onsite that a smaller working face and starting in the lower areas and bringing the LCID up to the higher elevations may be easier to meet rule, as well as to be diligent with layering waste, compacting, adding good soil cover of 6 inches or more, more often, and sloping 3:1.
15A NCAC 13B .0566 (3) - All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65.

3. The other side slopes were covered, compacted, and sloped well. Good job.
Side slopes, need perimeter road access installed. 4. EOW markers were installed on four corners, good job. Unapproved wastes were at a minimum. There were a couple tires onsite, one was removed by onsite staff during inspection. Please be sure other is disposed of at appropriate landfill. 5. Discussions onsite were also about future expansion. Mr. Powell emailed Mr. Byrd and Mr. Parker the contact information for Ming Chao, DEQ Permitting Engineer for Hoke County, and Sherri Stanley, DEQ Permitting Supervisor, on 9/6/2022.
6. It is recommended that anyone working at the landfill be familiar with the permit and 15A NCAC 13B .0566 OPERATIONAL REQUIREMENTS FOR LCIDLFS.
7. Corrective measures are necessary as a result of this inspection. These actions should be complete within 45 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
