Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On August 18, 2022, Chuck Kirchner met with Kenneth Phillippie to conduct ed a comprehensive inspection of the Phillippie LCID Landfill located at 4301 Kimesville Road in Burlington, NC, Alamance County. Facility Information: 1. The facility was formerly a notified LCID, N1079, Phillippie LCID. This facility was recently permitted on July 21, 2022. The LCID Notification, N1079, will be closed out at this time and the 01-08 permit shall cover all landfill activities at this facility. 2. The landfill is owned by Kenneth Phillippie and the operator listed on the permit is Phillippie Landfill, LLC. 3. This permit covers phase 1, 2 and 3 of the LCID landfill and the treatment and processing of Miscellaneous Solid Waste Management Unit (MSWMU). 4. An engineer written certification must be submitted to the division that the elevations of the landfill base in Phase 2 have been constructed per the approved plan prior to placing LCID material in this phase of the landfill. 5. A pre-operative meeting with this office is required prior to receiving waste at the new constructed cell per Permit Condition, Attachment II, Part V, Number 4(c). 6. The landfill is currently placing LCID waste in phase 1 of the landfill and is currently preparing phase 2 for landfilling operations. 7. The landfill has an approved disposal rate of 500 cubic yards per day. Mr. Phillippie stated that the landfill currently receives approximately 300 cubic yards per day. 8. The MSWMU is currently located in the phase 3 area. Records Review: 9. The permit and operations plan are maintained on site and were discussed during this inspection. 10. This facility has an erosion control plan with NCDEQ, DEMLR, permit number ALAMA-2022-039. Construction NPDES permit was issued with the erosion control permit. 11. The Alamance County Planning Department has approved a Heavy Industrial Intent to Construct Permit, Permit number 2021HID0002, on 7/22/2021, for the Phillippie Landfill Phase 2. 12. Phillippie landfill writes tickets for incoming loads. Tickets were observed during this inspection. Site Inspection: 13. Facility has proper signage. Provide additional sign which includes the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site as discussed on site. 14. Sediment basin and associated diversion berms have been installed around the phase 2 area and appear to be installed per the approved erosion control plan and functioning properly. 15. 15A NCAC 13B .0566 (2) states: “Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time.” 16. Permit Condition Attachment III, Part V, Number 11 and 15A NCAC 13B .0566 states in part: “All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first.” 17. Working face observed small and manageable during this inspection. 18. Unpermitted or non-conforming wastes that are inadvertently received at the facility shall be temporarily stored in leak-resistant containers for proper disposal. 19. No windblown litter was observed around the facility. 20. The waste disposal boundary must be accurately identified with permanent markers which shall be constantly maintained according to Rule 15A NCAC 13B .0201(g) per Permit Condition, Attachment III, Part V, Number 7. 21. On-site equipment, vehicle, or machinery shall be equipped with a portable fire control equipment such as a fire extinguisher per permit condition Attachment III, Part I, Number 7(b). Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. Miscellaneus Solid Waste Management Unit (MSWMU) Inspection: 23. The MSWMU is currently located in the Phase 3 area. Another area north of this area is approved for use in the future as shown on Sheet 2 of 13 of the approved landfill plan, dated 11/22/21 (FID 1692553). 24. LCID is ground for mulch and larger logs are staged in this area for transport to a lumber mill. 25. Per Permit Condition Attachment III, Part I, Number 7 (a), Areas of handling, treatment, processing, and storage the non-disposable waste (including yard waste and final products) of shall be surrounded by an unused and cleared area of no less than 25 feet to allow access for fire or emergency response vehicles. 26. The storage volume of the approved waste stream and size of each area are summarized in Permit Condition, Attachment III, Part VII, Number 8. Ensure approved waste streams do not exceed these volumes in the Treatment and Processing area. 27. No yard waste was observed in the MSWMU area. 28. This facility is permitted to receive up to 100 cubic yards of yard waste. 29. Mr. Phillippie stated that the landfill did not intend to pursue receiving yard waste at this time. General Information: 30. In the event of fire, the E.M. Hold Fire Department and the Burlington Fire Department can be contacted. 31. The E.M. Holt and the Burlington Fire Department have inspected the site and are aware of the location of the landfill. 32. Ensure a supply of cover material is maintained, with an adequate amount to immediately cover the working face at the landfill in case of an emergency or fire. 33. The site is secured by a chain link fence. Mr. Phillippie stated that the landfill is planning on replacing the chain with a gate system with keypad access. 34. An operator shall be on duty at all times while the site is open for public use to assure compliance with operational requirements and to prevent acceptance of unauthorized wastes. 35. Open burning of solid waste is prohibited. 36. Mr. Phillippie is currently applying for an Air Quality permit and may pursue using an air curtain burner on site in the future. 37. The owner or operator shall provide verbal notification to the Division of fires that occur at the site within 24 hours of the fire and shall submit a Fire Occurrence Report to the Division within 15 days of the fire. 38. The facility has a gravel all weather access road.
