Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility is permitted to receive solid waste generated by Blue Ridge Paper Products, Inc. 2. The facility accepts fly ash from multi -boilers, lime waste, wastewater treatment plant sludge, wood waste debris, cinders, biosolids and asbestos containing material (ACM). Asbestos containing material is landfilled in a separate area from all other materials. 3. The facility is approved for an average annual disposal rate of approximately 450,000 yds3. Records Review 4. Disposal records for the facility were available for review. The facility has landfilled 274,592 yds3 from January 2022 to July 2022. 6. Asbestos cell disposal records were provided for review. The facility has had two asbestos containing material disposal activities totaling 3,220 pounds to date in 2022. 7. Quarterly landfill gas monitoring records were provided by email. Landfill gas monitoring was conducted on August 23, 2021, October 18, 2021, March 21, 2022, and May 10, 2022. No exceedances were noted during the monitoring events. Ouerations Insuection of the Landfill Unit (4406-INDUS-1984) 8. Facility access is controlled by a gate. Signage with the facility name, permit number and the types of waste accepted was observed at the entrance of the facility. 9. The landfill access roads are constructed of concrete, asphalt and gravel and were in good condition at the time of inspection. 10. Edge of Waste (EOW) markers are installed around all fill areas of the landfill. Additional edge of waste markers have been installed since the 2021 inspection to better delineate the closed disposal areas. 11. The Asbestos Containing Material (ACM) Disposal Area is located on the east side of the facility. Asbestos containing material was disposed on April 21, 2022 and July 21, 2022. The disturbed area of the ACM area had been seeded, mulched, and matted. No erosion issues were noted in the ACM area. 12. The facility has three interconnected leachate ponds located to the south of Area B—Lower, and no visual deficiencies were observed in the visible portion of the liners. All three ponds had sufficient freeboard at the time of inspection. 13. The facility has developed a vegetative management plan for mowing and the removal of woody vegetation from the side slopes of the landfill. The facility is currently in the process of procuring contractors to begin the removal of the woody vegetation. Facility staff agreed that the removal of woody vegetation would be completed by March 1, 2023. 14. The facility is currently filling fly ash from multi -boilers, lime waste, wastewater treatment plant sludge, wood waste debris and cinders and pulp mill process waste in Area D. No unapproved waste was observed in the landfill at the time of inspection. 15. Closed areas F & H were observed to have good vegetative cover and no erosion issues were noted. These areas are cut for hay by local farmers. 16. A solar array is installed on the top of Area B — Lower. The vegetation cover is being maintained and no issues with the cap were observed.
