STATUS OF PAST NOTED VIOLATIONS: NA NOTICE OF VIOLATION: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 ADDITIONAL COMMENTS: 1. David Powell met with Ms. Angie Foster onsite for a requested Pre-Operational Inspection. Site has a Temporary Disaster Debris Site, and now a Compost and Treatment and Processing permit. This site has become a Large Type 1 permitted facility. The city wishes to keep the DS83-006 for emergencies. 2. Preoperational conditions for the City of Laurinburg’s 8303-TP-2021 Permit (ACI) have been met. Smith and Gardner Inc.’s’ Mike Brinchek submitted the Engineers Certification 8/2/2022 to the Section. 3. Site was clear of waste. Edge of Waste markers (EOW) installed for new permit modification, approved July 25, 2022, with new map sent 7/2022, seemed to be in appropriate placement according to map submitted. Be sure all waste storage, operations are inside of the approved area, less than one acre area and marked with EOW markers, and outside of the buffers also indicated on the 7/2022 map submitted to the Section with the latest permit modification. Be sure all permits/maps onsite at the ACI have been updated with the new and correct information for operators onsite. EOW markers installed The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Ash shed is finished. Currently the approved permit states in Attachment 3, Part VI, 32, “Ash resulting from operation of the ACI shall be mixed with the finished compost products at the designated area.” In deviation from approved operations should be approved by Section Permitting and be reflected in the current operations plan before it is put into effect. If the city wishes to pursue this pathway for ash to be land applied, then they should contact Chester Cobb, with the Environmental Compliance Branch, on how to be approved. His contact information is 919-707-8283 or chester.cobb@ncdenr.gov. Ash storage shed near entrance road. 5. Ms. Angie indicated she had received the SWANA Managing Composting Programs Certification. The city should have additional certified operators at the facility to be present when Ms. Angie is not present if they wish to continue to operate in her absence. Ms. Angie indicated that was her intention. A link to the Solid Waste Sections (SWS) compost training site was emailed to Ms. Angie on 8/2/2022. The signage at the TP, Air Curtain Incinerator (ACI), needed additional information to meet rule, was added as requested. Good job. Correct signage information that meets rule requirements. 7. Roadway was of all-weather construction at the time. Site is behind several city fenced facilities and is secured by gate. 8. A dumpster is onsite for removal of unapproved wastes. Good job. Dirt is onsite for fire suppression if needed. Ms. Angie also indicated that the city had recently meet again with the local Fire Department. 9. Facility plans to start operating the Air Curtain Incinerator, associated with 8303-TP-2021, on 8/1/2022. 8303-COMPOST-2021 still awaiting approval to operate. 10. Communicate with Division of Air Quality on meeting the requirements for startup of the ACI. Continue to communicate with Ming Chao, Solid Waste Section, to ensure all requirements have been meet and continue permitting process with Compost side.
