STATUS OF PERMIT: PTO Issued May 18, 2018, CLOSED INACTIVE Owner states no waste accepted since June 2021 PURPOSE OF SITE VISIT: Comprehensive Inspection – CLOSURE STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell with the Section inspected the Triple “A” Hauling Transfer Station to confirm last waste identified in 3/25/2022 inspection was removed as required. Gate was open upon arrival and Mr. Powell contacted Kenny Hardin, owner, and informed of his presence and intent to inspect the station. Mr. Hardin gave permission to enter. Mr. Powell also spoke with Office employee “Kathy”. Mr. Powell discussed closing the station with Mr. Hardin and removing the final waste from the site. Mr. Powell asked Mr. Hardin if he had received the letter emailed to him on the day previous, 7/20/2022, and he indicated he had not yet. Ms. Sherri Stanley, Permitting Supervisor, had recently spoke with Mr. Hardin on closing the station and followed up with a letter from the Section, yesterday 7/20/2022, explaining “…in order to accept waste at the facility again, you would have to provide a permit application with construction, operation, and closure plans for any new operations that meet the requirements of the readopted 15A NCAC 13B .0400 rules – effectively applying for a new permit. Therefore, pursuant to North Carolina Solid Waste Management Rule 15A NCAC 13B .0406, the Section has placed the AAA Hauling of NC, Inc. Transfer Station Permit, Permit no. 2613-TRANSFER-2010, in the Inactive/Closed status. A new permit will be required to reestablish operations.” 2. This Transfer Station had not submitted the required Transfer Station Assessment Report in accordance with 15A NCAC 13B .0401. Front signage is still removed. Transfer Station closure requirements are found in 15A NCAC 13B .0406. Some of the dates listed in this rule for closure, Mr. Hardin may already be beyond if the site was closed June 2021. Previously Mr. Ming Chao requested from Mr. Hardin on 3/31/2022 that he submit a closure report including cover page containing facility name, permit number, contact info including phone #, e-mail address, physical address; the date stop receiving wastes, and the date of cleanup the site. The last amount of waste is needed to be removed to appropriate disposal site and the requested document from Mr. Chao should be submitted as well within 30 days. Three roll-off containers left onsite, and the ones that were checked, were empty of waste. Roll off container, ones that were checked were empty during inspection. 4. Station had only a couple piles of waste onsite, from what seemed to be clean up activities. Some was wood chip comingled waste; painted pallet pile and a couple others were a mixture of windblown and C and D waste comingled with rock and soil from surrounding areas of conveyor/tipping floor. Windblown was minimal on southeast side but still some need removal. Please document waste removal. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 C and D waste left onsite Windblown and surrounding areas cleaned up but waste remaining needs removal. 5. No records were reviewed during this visit. Documentation should be submitted within 30 days as requested, including closure document outlined by Mr. Chao and any disposal documentation of waste piles Mr. Hardin may receive. This facility is considered CLOSED INACTIVE and can no longer accept any waste in the future without a new permit. 6. Corrective measures are necessary as a result of this inspection and should be completed within 30 days’ receipt of this inspection report. Mr. Hardin should communicate with Ms. Sherri Stanley and Mr. Powell on progress and submit required documentation within this time frame as well.
