STATUS OF PAST NOTED VIOLATIONS: NA NOTICE OF VIOLATION: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 9 ADDITIONAL COMMENTS: 1. David Powell and Drew Hammonds met with Ms. Angie Foster onsite for a requested Pre-Operational Inspection. Site has additional Pre-Operational Conditions to meet before can operate. Laurinburg will need an additional preoperational visit by Section staff before can operate under new permit, along with a preoperational visit by other DEQ Divisions. Site has a Yard Waste Notification, Temporary Disaster Debris Site, and now a Compost and Treatment and Processing permit. The Yard Waste Notification will be CLOSED, and the TP and Compost Permit will replace the notification. This site was previously indicated to be YWN-83-002 but was determined later to be YWN-83-003. Now, this site has become a Large Type 1 permitted facility. The city wishes to keep the DS83-006 for emergencies. 2. Upon arrival, some records were reviewed onsite. Ms. Angie had copies of Division of Air Quality permit, Sections permit and some engineer as built drawings. City of Laurinburg is using City of Shelby’s operational guide/slides to get started. A Sedimentation and Erosion Control Plan (SECP) was not available nor a NPDES permit for storm water/land disturbance and should be completed, and copies submitted to the Section. Upon speaking with DEMLR’s Tim LaBounty, it was noted that the Cities Engineer Firm, Smith and Gardener, has plans to submit the SECP soon and will then apply for an NPDES once the SECP is approved. Division of Air Quality also has additional preoperational conditions. The Title V air permit has the initial burning/air quality sampling requirements. The City must conduct the permit-required test, submit results, and receive an acknowledge from the NC DAQ that the initial sample/test result is acceptable or received, then the operation ACI is permitted. The copy of the approval letter/correspondence should be sent to the Solid Waste Section. The City must complete all pre-operational conditions (including the above-mentioned items, PERMIT NO. 2.c. d. & e. on Page 6 of 16) in the Solid Waste Permit; then the Solid Waste Management permit is valid. A written certification that is prepared by a Professional Engineer, registered in the State of North Carolina must be submitted to the Section to certify the permit conditions set forth in this Part are completed. Please note that the Solid Waste Management permit will not and cannot shield the City from violating any local, state, and/or federal rule or law. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. A sediment basin feature has been constructed onsite but no plans or an approved Sedimentation Erosion Control Plan were reviewed or available. All structures should be built to approved plans, designs and drawings. A preoperational meeting for the start of the onsite facilities will need to be completed before operations can begin. Before a preoperational meeting can be conducted, all plans, and required documentation should be completed and submitted to Section permitting/David Powell and the other appropriate Divisions contacts. Contact David Powell when all have been satisfied for scheduling the preoperational meeting. Site was clear of waste. Low areas may need soil or regrading to ensure no water is standing that can become leachate or runoff. Remember to not to put waste in water. Ms. Foster mentioned the Cities wish to use the ash as a soil amendment for farmers. Currently the approved permit states in Attachment 3, Part VI, 32, “Ash resulting from operation of the ACI shall be mixed with the finished compost products at the designated area.” In deviation from approved operations should be approved by Section Permitting and be reflected in the current operations plan before it is put into effect. If the city wishes to pursue this pathway for ash to be land applied, then they should contact Chester Cobb, with the Environmental Compliance Branch, on how to be approved. His contact information is 919-707-8283 or chester.cobb@ncdenr.gov. Ash storage shed near entrance road. 6. Ms. Angie indicated she had received the SWANA Compost Operator Training. The city will need additional certified operators at the facility to be present when Ms. Angie is not present if they wish to continue to operate in her absence. Permit Attachment 3, Part VI, 17 - No less than one operator, supervisor, or manager who are trained and satisfied the requirements of Rule 15A NCAC 13B .1406(19), N.C.G.S 130A-309.25, & the approved Operations Plan (FID 1619886) are present on-site during the operating hours. The permittee shall provide annual training for facility staff, including a review of the operations plan and permit documents. Training records shall be maintained at the facility and made available to the Section upon request. 7. First signage at the compost section of site has correct signage. The signage at the TP, Air Curtain Incinerator (ACI) needs additional information to meet rule. Roadway was of all weather construction at the time. Site is behind several city fenced facilities and is secured by gate. 9. Edge of Waste (EOW) markers were requested previously for the yard waste notification. Now with new permit, the operations area is much larger, but property lines should be marked so Section staff can ensure buffers in permit/15A NCAC 13B .1404 are met for large type 1 facilities when onsite inspecting. EOW markers were in for compost side of site. On May 31, 2022, Ms. Angie forwarded photos of EOW markers installed on ACI side of site as well, marking where waste will be placed/staged. Good job. 10. Air Curtain Incinerator (ACI) has been installed. It was suggested to keep copies of Approved Operations Plan and Permit inside along with O and M manual for ACI. If not here then these documents should be kept safe onsite at the facility for easy reference and for future inspections. ACI side view with blower. Corrective measures are necessary as a result of this inspection as well as additional preoperational requirements for the Solid Waste Section of Division of Waste management, Division of Air Quality and Division of Energy, Land and Mine Resources. Please follow up with these entities and finalize the preoperational requirements. Submit all required documentation to David Powell and Ming Chao with Solid Waste Section. Please contact the Solid Waste Section for a preoperational inspection when all requirements are installed and satisfied, according to approved plans, and site is ready.
