Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell with the Solid Waste Section (Section) visiting the site to conduct a comprehensive inspection of the Yard Waste Notification. Site has an all-weather road, good access and is gated. Site is not open to the public for dumping of any waste. Mr. Stephen uses the site to sort and stage land clearing waste from his business. No yard trash is brought onsite. Most goes out to be treated and dyed, such as Old Castle, for selling to homeowner and landscapers. Once the mulch is dye/treated at another site, some is brought back to sell to landscapers/homeowners etc. Some is sold as whole logs to mills and some to boiler fuel, such as Inviva or West Rock. Quantity onsite approximately 1,000 to 2,000 cubic yards. Site is less than 2 acres. Although its not required, four corner Edge of Waste (EOW) markers marking the notification area would be helpful to Section staff and onsite staff. Section staff can easily measure buffers and onsite staff will have an outline of where its approved for waste to be staged. Suggest tall white PVC pipe but these should be placed to meet buffers for a Yard Waste Notification. Entrance. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 Dyed mulch to be sold. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year. 3. Mr. Stephen and Mr. Powell walked site and discussed the waste staged onsite. Much of what’s onsite is sold and waiting to be picked up. Waste is sorted into different use piles to be mulched or logs to be sold. Older waste in rear of property has been here a while and should be sorted and utilized according to rule soon. Older waste needing removal/utilization according to rule. 5. Based on Mr. Stephens indication of the property lines, and confirming on Site Locator Tool online, the buffers are being met, although maybe close on the sides in couple areas. All yard waste should meet property line buffers of 100 ft from property lines. Although not a current dwelling, there is an office located within 200 ft from composting area onsite to the east. Caution and separation should be given, as much as possible, with the use of horizontal grinder operation. This would be prudent for safety and minimizing any noise potential, which may lead to complaints in future. Also be sure and keep separation from piles/windrows and access around them for firefighting. Be sure to remove the older mulch spread out in working area from time to time. Any water that comes into contact with the mulch is considered leachate and should be managed onsite and not allowed to runoff. Keep documentation of waste received and where waste is taken for future reference.
