Permit to Operate will expire April 17, 2025. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTICE OF VIOLATIONS: Date of Last Inspection: February 22, 2022 3505-MWP A. Permit to Operate Part VI (44)(C), "Waste may be stored on -site, in leak proof containers, with watertight covers, in accordance with the approved documents. Storage of the waste must not cause any nuisance, such as odor or attraction of vectors." and G.S. 130A 309.05 (c) (1), "Seventy-five percent (75%), by weight or volume, of the recovered material stored at the facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year." RESOLVED: The pile of shingles previously identified have been removed from the facility. A permit modification must be submitted to Diana Felix at diana.felixkncdenr.gov if the facility wishes to include asphalt shingle recycling. Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA OepaNnent W Environnrenbl puelily Solid Waste Section B. 15A NCAC 13B .0101 (28), "'Inert debris waste' means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead -based paint." CORRECTIVE ACTIONS IN PROGRESS: The countertop material is still being uncovered in the inert debris stockpile. The ground countertop material has been removed from the roadway from the scale to the inert debris pile. The facility is in the process of separating the countertop material from the inert debris stockpile and the remainder of the roadways. The countertop materials have been treated with sealants and have adhesives on the back and do not meet the definition of an inert debris as defined in 15A NCAC 13B .0101 (28). As identified in previous inspection reports, the sealed granite and quartz are considered to be unacceptable waste and MUST be removed from inert debris pile and disposed of at a permitted facility. Continue to remove the ground countertop material from the inert debris stockpile and roadways. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." and 15A NCAC 13B .0301 (6)(1)), "Buffer Requirements ... surrounded by an unused and cleared area of no less than 25 feet to allow access for fire or emergency response vehicles." The facility is in the process of installing an access roadway around the LCID; however, the roadway was constructed with the comingled ground countertop and concrete material. Ensure that the access roads are established and maintained around all areas for fire and emergency response vehicles. 2. A water truck is located at the property and is used to control dust emissions at the facility. At the time of this inspection, the water truck was being utilized to reduce dust emissions from the facility. 3. 15A NCAC 13B .0564 (6)(b), "Buffer Requirements: A site shall maintain the following buffer requirements: 100 feet from the waste boundary to property lines, residential dwellings, commercial or public buildings, and potable wells." and Permit to Operate Part VI (32), "A buffer of at least 100 feet must be maintained between the property line and the treatment and processing operation." Mr. Jarboe stated that the survey has been completed, but a map has not been finalized. Please provide the Section a copy of the updated site drawing, once completed. 4. Windblown was actively being picked up during this inspection. Ensure that windblown is removed prior to the end of the day. 5. The mulch located in the TP area was windrowed into smaller piles. No unacceptable wastes were observed within the mulch piles. 6. A metal building had been constructed to the north of the scale house. Mr. Jarboe stated that the building would be used for metal recycling. Ensure that the permit modification included all types of materials to be accepted and recycled at the facility. 7. The working face of the LCID was less than one acre. Mulch had been applied to the side slopes of the LCID to help prevent erosion and allow vegetation to be established. Ensure that all waste is covered with a minimum of 6 inches of soil every 30 days or when the working face reaches one acre, whichever occurs first. 8. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility. 9. Records were not reviewed during this inspection. 10. Digital pictures were taken during the inspection.
