Combined with 2803-CDLF-1995. PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: 15A NCAC 13B .0405 OPERATIONAL REQUIREMENTS, (11) Site Cleaning and Maintenance: Unless otherwise stated in the site permit, all waste shall be removed from the tipping floor, the truck loading bays, and from behind push walls by the end of each day of operation and disposed of in accordance with this Subchapter. Permit: Part VI TRANSFER STATION/TREATMENT & PROCESSING UNIT(S) DARE COUNTY TRANSFER STATION, 2805T-TRANSFER-1996, (3) (b) b. Waste must only be deposited on a “tipping floor” or directly into a transfer container. Waste must not be stored on the “tipping floor” after operating hours. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 ADDITIONAL COMMENTS: 01 - Life of Site Permit was issued 2/20/2017 as a combined permit with facility #2803- CDLF. 02 - Facility has required signage. Locking gates and fencing for security. Need to add operator & contact number (Stella Enviro.) on signage per new rule for Transfer Station. 03 - Interior roads are of all-weather construction and well maintained. 04 - This un-announced inspection was conducted at opening of the facility gates. Open hours are 7am to 4pm on Monday-Friday and 7am 12pm on Saturday. 05 - Upon arrival, the tipping floor had waste left from the day before. Approximately 6 plus loads were remaining on the tipping floor. Lack of empty trailers. 06 - No leaks were noted on the 8 covered & loaded trailers during this inspection. Facility had 0 empty trailers available to start this working day that was observed by John College. 07 - Jonathan DeWeese, Landfill Supervisor was notified, and he then notified, (via text message) the Republic Services (Waste Contracting Company), representative Pat (Patrick) Carldelle – Hauling Supervisor, of possible facility closure due to above issues. 08 - Republic Services contracts the facility operations and the hauling to Stella Environmental. 09 – Mr. Carldelle, Republic Services, contacted Stella Environmental and had them send a constant fleet of empty trailers and to haul out the loaded trailers to ensure this facility was brought back into compliance. 10 - With the above actions taken, all of the waste was removed from the tipping floor and loading bays by 8:00 pm. 11 - Bertie County Regional Landfill (0803-MSWLF) remained open to accommodate the incoming loads of this waste. 12 - The staff at this Transfer Station did a good job in this steady removal of waste and keeping up with the windblown trash. 13 - Observed violations are noted on page 1 of this report. 14 - Removal for waste from the tipping floor must be completed daily. A Notice of Violation will be issued if this type of event happens again. Potential Closure of this facility may also be required at such times until the facility is back in compliance with the permit conditions and rules for this facility. 15 - Digital pictures were taken during this inspection and some are attached to this report. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
