PURPOSE OF SITE VISIT: Comprehensive Facility Inspection. STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The site is a former industrial landfill that operated under Permit No. 1102-INDUS-1980. A Letter of Closure for the BASF Industrial Landfill was issued for Permit No. 1102-INDUS-1980 on March 13, 2006. During post -closure of the site, the facility coordinated with the NC Brownfields Program to redevelop portions of the closed landfill under NC Brownfields Project No. 15011-11-11. Since the previous Section inspection, ongoing construction and maintenance of the Bob Lewis Ballpark complex was observed on portions of the closed landfill site (PIN 961764308400000), which is currently owned by the Enka Youth Sports Organization, Inc. Additionally, during this inspection, grading and construction activities were observed on parcels directly adjacent to the Brownfields Project. ISSUES RELATED TO NC BROWNFIELDS PROJECT NO. 15011-11-11, CLOSED BASF LANDFILL: 2. The site -wide Groundwater and Surface Water monitoring network currently includes 2 monitoring wells (MW-4R & MW-5) and 2 surface water sampling locations (SW-1 & DW-2) that serve to monitor the closed industrial landfill. Additionally, the site -wide landfill gas (LFG) monitoring system currently includes 9 monitoring wells (LG-2 through LG- 10) that serve to function as a methane monitoring system for the closed industrial landfill. During this inspection, monitoring wells MW-5 and LG-1 could not be located, monitoring well LG-4 could not be accessed due to bees and vegetation, monitoring well LG-10 had fill placed around it and appeared to have been extended (photo #1), and monitoring wells LG-10 and LG-7 were not locked (photos #1 & #2). As stated in the Annual Monitoring Report to the Section dated December 3, 2021 (FID 1626390), "LG-1 was destroyed at an unknown time by road construction activities performed between March and June 2019. Neither BASF or ELMSS were contacted regarding this incident." As confirmed post - inspection with BASF's consultant ELM Site Solutions, Inc. (ELMSS), MW-5 was located and sampled during the Spring 2022 sampling event at the site, but the well was surrounded by heavy vegetation. BASF should maintain the locks on monitoring wells LG-7 and LG-10, but it appears no additional action is required by BASF at this time. Enka Youth Sports Organization, Inc. should continue to coordinate with the NC Brownfields Program regarding the environmental monitoring well network and status at the site. 1. Since the previous inspection, it appeared additional fill material had been placed on the northwestern side of the site, behind Ballfield #1 (photos #3 & #4). Please ensure this area is stabilized as necessary to prevent erosion. 3. Western view of fill area behind Ballfield #1 on northwestern side of site. 4. Since the previous inspection, construction was observed on parcels adjacent to the Brownfields Project (photos #5 & #6). Enka Youth Sports Organization, Inc. should continue to coordinate with the NC Brownfields Program to ensure the redevelopment project is not impacted from ongoing, nearby construction activity. 5 & 6. During this inspection, some Edge-of-Waste(EOW)/Landfill Boundary markers were observed on -site. Continue to maintain EOW markers at the site as necessary. 6. Copies of this report are being sent to BASF, the property owner, and the NC Brownfields Program. The Solid Waste Section will also follow-up directly with Brownfields' Program staff to ensure any corrective action noted in this report needed to maintain compliance at this facility, is addressed. OTHER LANDFILL COMMENTS: 7. Access to the site is located off Jacob Holm Way at 5 Walk Off Way in Enka, NC. The ballfields and parking lot are controlled by fencing and a lockable gate. 8. Since the previous inspection, the facility requested and was approved (FID 1469228) to monitor groundwater and surface water on an annual basis and to monitor LFG on a semi-annual basis, beginning in 2021. The most recent facility Annual Monitoring Report is dated December 3, 2021 (FID 1626390). Previous monitoring reports for the facility were also available for review. As required, continue to monitor all groundwater, surface water, and LFG sampling locations at the facility and submit reports to the Section. Also, continue to maintain access for all environmental monitoring locations at the site as necessary. 9. No LFG exceedances were noted in the Annual Monitoring Report dated December 3, 2021. 10. Landfill cap and slope mowing maintenance efforts were observed during this inspection. Continue to maintain the integrity and effectiveness of the final cover system at the site. Small shrubs and trees on landfill slopes should be removed during mowing events at the site (photos #7 & #8). After mowing events occur at the facility, continue to ensure the landfill cap is inspected for potential impounded water, subsidence/differential settling, cracking, signs of erosion or damage, and that any necessary repairs are made in a timely manner. 7. Note: No EOW markers observed in this area. 11. During this inspection, an eroded area/gulley was observed behind the scoreboard of Ballfield #1, on the upper slope in this area (photos #9 & #10). Rip -rap was observed in the eroded gulley. Continue to maintain the slope in this area as necessary. Continue to maintain all erosion control measures at the facility as necessary including rip -rap channels, sediment detention basins, permanent diversions, and inlet/outlet stabilization structures. 13. No apparent ponded/collected water was observed on the closed industrial landfill cap. Continue to maintain surface water control(s) for this facility as necessary. 14.
