The Permit renewal paperwork was submitted to the Section on April 20, 2022. PURPOSE OF SITE VISIT: Comprehensive Compliance Inspection and introduction of Tim Davis STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. Page 1 of 5 NORTH CARnLINAD_E Q�� OepaNnent W Environnnnbl puel� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility operating hours are Monday through Saturday from 6:00 am to 7:00 pm. The hours may be adjusted based on facility demand. 2. Signs stating emergency information, facility name, permit number, and other required information are installed at the facility entrance gate. 3. This facility is secured by fences with locking gates. 4. The Permit, Operations Plan, and waste screening logs were reviewed during this inspection. 5. Permit to Operate, Attachment 3, Part 1 (4), "A responsible individual trained and certified in facility operations must be on -site at all times during all operating hours of the facility, in accordance with N.C.G.S. 130A-309.25. An attendant must be present to oversee the loading and unloading of waste." The facility has one certified operator: Dan Jarboe, Certified Manager of Landfill Operations, Certification Number 7851689, Exp. 9/5/2024. During this inspection, it was noted that Mr. Jarboe was the only certified personnel for at least 3 different facilities for Mr. Wall. It was stated during this inspection that additional personnel would need to be certified, so that a certified operator was on -site during the operating hours. A training class has been scheduled for June 3, 2022 at the facility. 6. Permit to Operate, Attachment 3, Part 2 (1), "The permit to operate for the construction and demolition debris (C&D) processing facility shall expire May 8, 2022. Pursuant to 15A NCAC 13B .0201(c) and .0201(g), no later than November 8, 2021, the permittee must submit a request to the Section for a permit amendment and must update pertinent facility plans including, but not limited to, the facility plan, operation plan, and waste screening plan." The Permit renewal paperwork was submitted to the Section on April 29, 2022. Ensure in the future that the renewal paperwork is submitted at least 6 months prior to the expiration of the Permit. 7. The waste streams appeared to be relatively clean during this inspection. Any unacceptable wastes need to be removed from the waste streams and properly disposed of as they are encountered. Continue to ensure that the unacceptable wastes are removed and properly disposed of. 8. Permit to Operate, Attachment 3, Part 2 (6)(b), "Except for wood, concrete and clean soil, recoverable materials must be placed in containers. Recovered materials placed in containers must be removed from the site once the container is full, unless otherwise approved by the Section." Large individual piles of cardboard, metal, and asphalt shingles were located south of the operations area. As per the Permit conditions, the cardboard, metal, asphalt shingles, and any other recovered materials need to be placed in containers and the containers removed from the facility once full. 9. Permit to Operate, Attachment 3, Part 2 (8)(d), "Litter and windblown materials must be collected by the end of the day. No windblown materials may be allowed to leave the facility boundary." Windblown litter was observed throughout the facility. Some of the waste was observed within standing water along the eastern site boundary. Additional windblown waste was observed to the west of the block barricade along the western operations boundary. Ensure that the windblown waste is collected and properly disposed of by the end of the day. 10. Crushed brick and concrete that was comingled with countertop material, painted brick/block, metal and additional C&D materials was observed to the west of the block barricade along the western operations boundary. A similar large pile of the comingled waste was also observed in the northern portion of the site, within the concrete processing area. Mr. Hill stated that the comingled waste would be removed from the western side of the operating area. Mr. Jarboe also stated that the comingled waste was sent to landfills to be used on the roadways within their edge of waste. Ensure that the comingled waste is only utilized at permitted landfills and not sold to private customers. 11. Several areas of standing water were observed at the base of the land clearing waste stockpile and the clean wood waste stockpile. Mulch was found to be blocking the drainage holes within the block barricade. The land clearing waste and clean wood waste areas should be repaired and graded so that water is shed away from the waste. The mulch needs to be removed from the block barricade so that the water can drain to the stormwater collection system. 12. Several creosote timbers and treated telephone poles were identified in the "clean" wood pile. Mr. Hill stated that the timbers and telephone poles are sorted and removed from the pile prior to grinding. The timbers and telephone poles are sent to South Wake Landfill for disposal. Continue to ensure that the timbers and telephone poles are properly disposed of and not ground with the clean wood. 13. The excavator was sitting on top of a pile of comingled C&D waste. Mr. Hill stated that the pile of C&D waste would be removed from the "tipping floor" prior to the end of the operating day. As per Permit to Operate, Attachment 3, Part 2 (6)(a), "C&D waste must only be deposited on the designated tipping floor, directly into a transfer container, or directly into a recycling container. C&D waste placed on the tipping floor must be sorted each operating day, and no waste shall remain on the pad after operating hours unless covered by tarp to prevent leaching by rainfall. Only an amount of waste sufficient to begin sorting operations the next day may be left on the tipping floor." any C&D waste left on the floor must be covered with a tarp at the end of the operating hours. Water was being sprayed onto the conveyor belt of the sorting line during loading activities to help reduce dust emissions. Continue to ensure that dust emissions are being controlled during operations at the facility. 14. Please follow the Permit and approved operations plan for this facility. Changes should be submitted to permitting before going forward. Corrective measures are necessary and should be completed within 30 days receipt of this inspection. 15.
