Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS The facility is a residential convenience collection and transfer facility for solid waste and recyclables. The Town of Cary is not currently utilizing the facility as a transfer station as the Town collects and hauls MSW directly to the South Wake Landfill (Permit# 9222-MSWLF-2008). The Town has recently renewed their Permit to Operate on 2/17/2022 with the intention of utilizing the facility as a transfer station if necessary. 1. The facility is fenced and is secured by a locking gate when it is not open for operation. 2. The correct signage is at the entrance of the facility listing the facility name, permit number, hours of operation and emergency contact information, as well as materials accepted at the facility. 3. The facility accepts waste Monday through Saturday from 8:00am to 6:00pm and Sunday 1:00pm to 6:00pm. 4. The facility permit, operations plan, and training records were not available during this inspection as the file cabinet was locked. Only one operator certification was viewed. The following are facility certified personnel: a) Sammie Chance, Certified Transfer Station Operation Specialist, TS-2016074, exp. 11/3/2022 5. The transfer portion of the facility does not currently function but consists of a 300 sq ft concrete tipping deck, the remnants of a charging hopper, and an adjacent concrete loading bay. Waste was noted in and around the concrete loading bay. Ensure all waste is picked up and removed from these areas. 6. The facility grounds were clean and windblown waste was being managed properly. 7. Some waste and possible leachate was observed underneath the compactor during this inspection. Ensure all waste is picked up by the end of each operating day and ensure the compactor and transfer trailers are inspected for deficiencies and repaired as needed. 8. Waste screening is completed on each load by facility staff. Any items identified as prohibited are removed and the customer is informed of the proper disposal facility for the item. The facility does not accept scrap tires. 9. The facility contracts with American Greenz for collection and recycling of electronics. Electronics are stored in a small, enclosed shed and managed weekly. 10. White goods are stored upright within a concrete bin block walled area to the west of the convenience collection area. White goods are taken once per week by the Town to the South Wake Landfill. 11. Yard waste is collected from residential customers according to the Operations Plan. Vegetative debris is loaded into a trailer and hauled to McGill Environmental Systems – Merry Oaks Facility (Permit#19-06) daily. At the time of this inspection, unacceptable waste was observed within the yard waste area. Ensure all unacceptable waste is screened and removed from the yard waste area and properly disposed of. 12. Segregated leaves are hauled to Brooks Compost Facility (Permit#19-05). At the time of this inspection, it was noted that standing water was present at the base of the leaf collection pile. Yard waste collection areas should be graded to divert water away from waste to eliminate or reduce production of leachate. It was also noted that large quantities of decomposed leaf litter had been pushed or had fallen over the edge of the steep hill located to the southwest of the convenience collection center. A wetland area and intermittent stream bed are located at the base of this hill according to the U.S. Fish & Wildlife Service’s National Wetlands Inventory Mapper. According to 15A NCAC 13B .1404 (a)(9)(A) “A site shall not cause a discharge of materials or fill materials into waters or wetlands of the State that is in violation of Section 404 of the Clean Water Act.” Ensure all the decomposing leaf litter is pulled back off the base and side of the hill and onto the proper temporary staging area. 13. During this inspection, a neglected monitoring well was observed south of the convenience collection center and west of the storage building lot which borders the facility property to the south. Ensure the monitoring well is identified as to its purpose, and if no longer in use, ensure it is properly abandoned. 14. Digital photographs were taken during the inspection.
