Status: Resolved - 15A NCAC 13B .1626(2)(b) – cited for failing to provide adequate cover over of disposed solid waste. All slopes around working face observed to have adequate cover and no exposed waste was observed. Status: Resolved - 15A NCAC 13B .1626(8)(d) – cited for leachate not being contained within a lined disposal cell or leachate collection and storage system or being treated, as required by the receiving facility, prior to discharge. No evidence of leachate leaving Phase 3A or 3B was observed during this inspection. Status: Resolved - 15A NCAC 13B .1626(11) – cited for windblown material resulting from the operation not being collected and disposed of by the owner or operator at the conclusion of each operating day. All slopes around the working face were observed to have minimal windblown material on them. Windblown material observed appeared to be from recent landfill operations. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 4 ADDITIONAL COMMENTS On May 4, 2022, Chuck Kirchner met with Mike McFeeley to conduct a compliance inspection of the Great Oak Landfill per the March 10, 2022 Notice of Violation. 1. Facility is now in compliance with the Notice of Violation issued on March 22, 2022 for violations observed on March 10, 2022. 2. Liner installation in phase 6 and phase 7 is expected to be complete at the end of the day. 3. Mr. McFeeley stated that the sump would be installed next and then the protective layer would be installed. Waste Management is expecting to complete this work and all remaining permitting requirements by the end of May and begin placing waste in this area in June. 4. The working face was observed to be small and compact. 5. A very minimal amount of windblown material from current activity was observed outside of the working face. Ensure this material is returned to the working face at the conclusion of each day of operation. 6. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
