Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On April 27, 2022, Chuck Kirchner met with Alan Stone to conduct a comprehensive inspection of the ARBD LLC dba Stone Company LLP LCID Landfill. 1. The facility is a land clearing and inert debris (LCID) landfill. 2. The facility is owned and operated by Alan Stone. 3. The landfill is on 25 acres of a 35-acre property and is permitted to receive a total gross capacity of 920,721 cubic yards including the 243,936 cubic yards in the phase 4 (5.58-acre) section of the landfill. 4. The erosion control permit is approved for Phase 5 and Phase 5 erosion control measures are being installed. 5. No LCID waste may be placed in Phase 5 until the Solid Waste Permit is approved for OPERATION in Phase 5. OK to remove soil from this area as discussed in the field. 6. The facility entrance is located on Rock Hill Drive. Rock Hill Drive is a gravel road that intersects Big Woods Road. 7. The facility is open Monday through Thursday 7:00 am to 5:00 pm, Friday 7:00 am to 4:00 pm, and Saturday by appointment only. 8. The facility permit, site plan, and operations plan were discussed. 9. The facility permit is for the operation of Phases 1, 2 and 3 and the construction and operation of Phase 4. 10. The facility is currently operating in Phase 4. 11. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 12. The facility is permitted to receive waste generated in Alamance, Chatham, Durham, Lee, Moore, Orange, Randolph, and Wake Counties. 13. The facility maintains throughput records of the amount of LCID material received. Records were observed for January 2020 through March 2022. 14. The facility annual report (FAR) was received by the SWS dated July 22, 2021. The facility throughput for July 2020 through June 2021 is ~ 6,750 tons. 15. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. 16. The working face appeared small and compact. 17. All waste shall be covered with no less than six inches of soil monthly or when the active area reaches one (1) acre in size, whichever occurs first. More frequent cover may be required as stated in the permit. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. 18. Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill shall be stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. 19. A ready supply of soil from the property is available for cover material. 20. Excavation, grading, and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical feet (3:1). 21. The exterior side slopes are constructed with benched lifts. Mr. Stone previously stated that when the landfill nears closure, additional material will be placed on the benched lifts to create uniformly graded exterior side slopes. 22. Phase 5 areas of the landfill where erosion control measures are being installed have been recently seeded and mulched. Continue to seed and mulch disturbed areas until grass cover germinates enough to restrain erosion of landfill cap and disturbed areas around the landfill. 23. The Solid Waste Permit dated February 9, 2021, Attachment III Conditions of Permit to Operate, Item Number 4 states: “The permanent markers that delineate the waste disposal boundary must be maintained at all times.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 24. The facility maintains a NPDES permit NCG010000, Certificate of Coverage NCC190103, effective 4/25/19 and valid through the duration of the project. 25. The facility has a Sedimentation and Erosion Control Plan with Chatham County, Project number 2018-01918, effective 5/9/19 and valid through the duration of the project. 26. The facility has a conditionally approved temporary disaster debris staging site (TDDSS) on the property. The TDDSS number is: DS19-005 located in the Phase 5 area. Ensure Phase 5 Solid Waste Permit Application shows the location of this and addresses desired disposition of the TDSR. 27. Effective January 1, 2021, the establishment of temporary debris storage and reduction sites (TDSRs) and the management of debris and wastes regulated under 15A NCAC 13B are required to meet the provisions of rule 15A NCAC 13B .0208(b) in order to be temporarily exempt from solid waste permitting requirements. 28. Any TDSR located at the LCID Landfill should be shown on engineered plan sheets. 29. The North Chatham Fire Department can be contacted to address an emergency at the facility. 30. An attendant is on duty when the facility is open to the public. 31. Access roads are of all-weather construction. 32. The facility is secured by a metal cable with a padlock. 33. The facility has a proper sign.
