Pursuant to NCGS 130A-294(a2), this PTO shall expire 3 September 2032. PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection without records review STATUS OF PAST NOTED VIOLATIONS: None applicable OBSERVED VIOLATIONS: 1) 15A NCAC 13B .1626 (1)(g) states “Waste placement at MSWLF units shall be within the areal limits of the base liner system and in compliance with the effective permit.” 2) 15A NCAC 13B .1626 (2)(b) states “Except as provided in Sub-Item (c) of this Item, the owners or operators of all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors.” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 2509_INSP_20220406 Page 2 of 5 3) 15A NCAC 13B .1626 (7) states “Erosion and sedimentation control requirements. Erosion control measures consisting of vegetative cover, materials, structures, or other devices shall be utilized to prevent silt from leaving the site and to prevent on-site erosion, and shall comply with 15A NCAC 04, which is incorporated by reference including subsequent amendments and editions.” 4) 15A NCAC 13B .1626 (8)(b) states “Surface water shall not be impounded over or in waste.” ADDITIONAL COMMENTS: 1) This Facility is a Municipal Solid Waste Landfill and a Large, Type 1 Composting Facility. 2) This Facility is permitted to receive Municipal Solid Waste, Construction & Demolition Waste, Yard Waste, Land-clearing Debris, and Scrap Tires generated in Carteret, Craven, Jones, and Pamlico Counties and all municipalities and Federal facilities within the boundaries of these four counties. 3) This Facility is recorded with the Craven County Register of Deeds at Book: 2251; Pages: 957-963. 4) Proper signage including the Facility permit number, accepted waste types, banned or excluded items, hours of operation, and the emergency contact number is posted at the Facility entrance. 5) The Facility is secured by means of a locked gate at the main Facility entrance and by a locked gate at the Ingenco Facility Entrance. 6) The security gates were open upon my arrival and Facility personnel were on site during this Facility Compliance Inspection. 7) The Facility access road is of all-weather construction and is being maintained in overall good condition. 8) The hours of operation are Monday through Friday 7:30 AM to 4:30 PM and Saturday 7:30 AM to 2:00 PM. Three Holidays are observed: New Year’s Day, Thanksgiving Day, and Christmas Day. 9) This Facility is permitted to use leachate for dust control within the liner limits. 10) The Municipal Solid Waste Facility is currently operating in Phase IV. 11) This Facility is currently receiving +/- 650 tons of waste per day. 12) This Facility is approved for the use of Posi-shell as an alternative daily cover system. 13) Landfill gas is collected and used in the generation of electricity at the on-site Ingenco Energy Plant. 14) The Ingneco plant was in operation during this Facility Compliance Inspection. 15) A residential waste management area is maintained off of the main landfill access road to reduce the amount of small vehicle/small load traffic at the landfill working face. Roll-off containers are staged in this area for the collection of residential waste. Full containers are transported to the landfill working face to dispose of the collected waste as needed. This element and the around the containers appears well-maintained at this time. 16) Compost operations were underway during this Facility Compliance Inspection. 17) All composting activities are maintained on the concrete pad. 18) All unprocessed vegetative materials are maintained separate from the compost windrows. 19) All compost piles are maintained with adequate space around the piles for turning, maintenance, and fire suppression. 20) Finished compost is maintained in separate piles in an area away from the compost windrows to prevent contamination from un-composted materials. 21) All dimensional lumber is maintained separate from the vegetative debris piles. All dimensional lumber is ground for removal from the site and used as boiler fuel or used at the working face tipping deck for soil stabilization. 22) Scrap tires are staged in a concrete bunker adjacent to the wood waste grinding area until placed into trailers for transport to the tire management facility. 23) Areas of differential settlement or ponding water were observed in the closed areas of the landfill during this Facility Compliance Inspection. *Within thirty days of receipt of this Facility Compliance Inspection Report, please fill and grade these areas to promote the positive flow of surface waters from the landfill. All repaired areas should be filled, compacted, graded at a slope not greater than 3:1, and mulched and seeded to establish a groundcover suitable to prevent erosion of your landfill cap system. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 2509_INSP_20220406 Page 3 of 5 24) Overall, a cover crop of native warm season grasses has been well established and maintained in the closed areas of the landfill. However, areas of sparse cover and erosion were observed in several areas of the landfill. Some of these areas have recently been repaired. Leachate was observed seeping in several of the recently repaired areas. The majority of these seeps were observed on the outside slopes downslope from areas of ponding surface waters. *Within thirty days of receipt of this Facility Compliance Inspection Report, please repair all areas of sparse cover and erosion. All repaired areas should be filled, compacted, graded at a slope not greater than 3:1, and mulched and seeded to establish a groundcover suitable to prevent erosion of your landfill cap system. Corrective measures should be taken to prevent the release of leachate from the landfill liner limits. 25) The cover crop is mowed throughout the year as needed. 26) The leachate collection system cleanouts are highly visible, readily accessible, protected, and well maintained. 27) Leachate is treated and stored in on-site leachate containment lagoons until pumped by force main to the City FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 2509_INSP_20220406 Page 4 of 5 of New Bern Wastewater Treatment Plant. 28) The stormwater/sedimentation control basins and surface water ditches were clear of vegetation and wind- blown debris and appear well maintained at this time. 29) Soil is stockpiled adjacent to the working face for use as cover. 30) The waste type in the landfill was reviewed; the waste type being disposed is MSW and no unpermitted wastes were observed during this Facility Compliance Inspection. 31) Areas of erosion were noted and exposed waste was observed in the northern leg of Phase IV. *Within thirty days of receipt of this Facility Compliance Inspection Report, please cover all exposed waste with clean borrow soil and repair all areas of erosion. All newly covered and repaired areas should be filled, compacted, graded at a slope not greater than 3:1, and mulched and seeded to establish a groundcover suitable to prevent erosion of your landfill cap system. 32) This Facility has been utilizing reclaimed cover soil from the previous day’s operations for constructing the outside disposal boundary berm at the toe of the working face and for daily cover. This soil contains solid waste and is unacceptable for these uses. *All soil contaminated with solid waste should be pulled back to within the liner limits and covered with clean borrow soil. Moving forward, only clean borrow should be used for constructing the disposal boundary berm at the toe of the working face. Also, only posi-shell or clean borrow soil should be used as final daily cover.
