The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS

1. A gate was provided at the entrance to the facility to prevent unauthorized access.
2. The landfill cap was covered with native grasses.
3. Semiannual groundwater monitoring was being performed as required. Records were verified for monitoring
events performed on December 6-8, 2017; May 24-25, 2018; December 18-19, 2018; June 11-13, 2019; November
13-14, 2019; June 3-5, 2020; November 18-19, 2020; and June 8-9, 2021.
4. Methane monitoring was being performed quarterly in conjunction with monitoring for the active Ashe County
MSWLF. Records were verified for monitoring events performed on 12/6-8/17, 3/20/18, 5/24-25/18, 8/29/18,
12/18-19/18, 3/25/19, 6/13/19, 9/16/19, 11/11/19, 3/30/20, 6/15/20, 9/18/20, 11/19/20, 8/30/21, 6/9/21, 9/23/21,
12/2-3/21, and 3/3/22. No exceedances about applicable standards were documented.
5. No significant settling was observed.
6. Edge of waste markers were in place at the time of inspection.
7. Vehicle ruts with standing water were observed on the southern portion of the landfill near the location where
electronics are managed. These ruts must be repaired to prevent standing water. Upon repair, please ensure all
graded areas are stabilized with a groundcover sufficient to restrain erosion.
8. An area of bare soil measuring approximately 5-feet x 25-feet was observed near the toe of the slope on the
northern portion of the landfill. This area was just below the waste containers used for the collection of empty
pesticide containers. Please ensure this area is stabilized with a groundcover sufficient to restrain erosion.
9. An area of bare soil measuring approximately 3-feet x 3-feet was observed near the toe of the slope at the
northwest corner of the landfill. Please ensure this area is stabilized with a groundcover sufficient to restrain
erosion.
10. Trees and dense brush were growing on the western facing slope of the landfill at the toe. Trees should be
managed to prevent damage to the landfill cap. All dense brush must be removed from the landfill. Mr. Hurley
stated he did not believe the waste extended beyond the wooded area as indicated by the edge-of-waste markers in
stalled on site. Mr. Hurley stated the County would take steps to ensure the edge-of-waste in this area is accurately
marked.
11. A seep was observed during the inspection near the toe of the slope at the southwest corner of the landfill.
Soil was eroded in this area leading beyond the toe of the slope to an old sediment basin below. Inspection of
the area found it difficult to determine if liquid in this area was stormwater or leachate. The following
actions must be taken to address this concern.
x The slope must be repaired and stabilized with a groundcover sufficient to restrain erosion.
x This area must be investigated to determine if the seep is a leachate outbreak. If investigation
determines this is a leachate outbreak, Ashe County must contact Perry Sugg, Hydrogeologist, to
determine the requirements for a soil sampling plan.
