The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS:
1. All photos included in this report were taken by Susan Heim during the inspection on March 18, 2022.
2. The facility is permitted as an LCID landfill, a small Type 1 compost facility, and a treatment and processing
facility for wood waste and used concrete. It is permitted to accept only land clearing debris, untreated wood,
yard trash, and inert debris that is strictly limited to untreated/unpainted concrete, brick, concrete block,
uncontaminated soil, rock, and gravel. Current wood waste operations do not include composting.
3. The purpose of this inspection was to view the completed construction of Phase 3, prior to allowing landfill
operations to begin in this new phase. The landfill is currently operating in Phase 2, which Mr. Boyles estimated
to be approximately 75% filled at the time of this inspection. No waste may be accepted in Phase 3 prior to
Mr. Chao's approval to begin Phase 3 operations. (See Comment 10 below for additional information.)
4. In general, the facility appeared to be well -maintained, and operations were observed to be well managed. No
windblown litter was noted, and no unacceptable waste was identified in the landfill or in the wood waste
operations areas.
5. Mr. Boyles stated that construction of Phase 3 is complete, even though the finished depth is shallower than that
shown on the approved plans. He explained that the wet weather had made it impossible to complete excavation
in a timely manner so that the new phase would be available for use this spring. Mr. Boyles added that he
understands no further excavation will be allowed after the as -built drawings have been submitted and
approved.
6. Erosion control measures were observed to be in good condition and the new basin appeared to be functioning
properly. Mr. Boyles pointed out the completed drainage swale that conveys surface water from the south side
of the facility to the basin, located in the facility's northwest corner. The swale is accessible from the interior
facility roadway, so that cleaning and repairs can be accomplished easily.
7. Edge of waste markers were observed around the perimeter of the entire landfill as well as around the outside
boundary of Phase 3. Markers were spaced so that the perimeter of the fill area is easily discernable along each
side of the landfill, as required.
8. The excavated area of the newly constructed Phase 3 aligned with the edge of waste markers that had been
installed prior to the original facility permit being issued. The excavated slopes appeared to be stable, and no
signs of erosion were visible, and no ponding water was noted on the floor of the new cell.
9. Several piles of soil from the new cell construction were staged in Phase 3 for use as cover on the northern side
slopes as fill operations proceed.
10. Based on this inspection, Phase 3 appears to have been constructed as shown on the approved plans. Please
provide as -built drawings and a construction certification to Permit Engineer Ming-Tai Chao
(ming.chao(&ncdenr.gov) when they are completed. Mr. Chao will then review these materials and, once
they are approved, he will provide approval for the facility to begin accepting waste in Phase 3.
