Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1. Prior to operating as a construction and demolition landfill (CDLF), the facility operated as an unlined municipal solid waste landfill (MSWLF) which consisted of two units. The first unit was closed prior to October 1991 and the second unit closed prior to December 31, 1998. The MSWLF’s designated permit number is 8603-MSWLF- 1981. 2. The CDLF (8603-CDLF-2000), located on top of the closed MSWLF, ceased operation on June 30, 2008. 3. A gate was provided at the entrance to the facility to prevent unauthorized access. x A cable with lock was also provided at the entrance to the access road leading to the landfill from Joe Layne Mill Road. 4. The majority of the landfill was stabile with native vegetation. However, one bare area was observed on the northwest facing slope. It appeared that past attempts to stabilize this area had failed leaving bare soil. However, no erosion of the soil was observed. This area of bare soil must be stabilized with a groundcover sufficient to restrain erosion. 5. Minor damage from ATV traffic was observed on the southwest facing slope. Mr. Southard brought multiple signs to facility during the inspection. The signs will be installed at the landfill to discourage ATVs and horseback riding across the landfill. Please ensure all damage to the slope is repaired and stabilized with a groundcover sufficient to restrain erosion. 6. No significant settling was observed on top of the landfill. 7. Edge-of-waste markers were in place around the perimeter of the landfill consisting of white PVC posts. 8. Trees were growing on the southern slopes of the landfill. Please ensure trees are managed such that the integrity of the cap is not compromised. 9. Semiannual groundwater monitoring was being performed as required. Monitoring records for 1st and 2nd semiannual sampling events for 2019 and 2020 were verified via the Division of Waste Management Document System. Records for the 1st semiannual sampling event for 2021 was also verified. 10. Methane monitoring was being performed quarterly as required. Records for monitoring events performed on 6/19/19, 9/18/19, 11/27/19, 3/5/20, 6/23/20, 8/27/20, 12/21/20, 2/23/21, 6/25/21, 10/19/21, and 1/18/22 were verified. x Landfill gas was detected above the lower explosive limit for methane at MGP-1 during sampling events performed on 6/23/20 and 2/23/21. However, retests performed on 6/26/20 and 2/25/21 found no methane detections at MGP-1. No other exceedances above applicable standards were observed. MGP-1 is located north of the landfill, but quite far from the property boundary.
