(FID 1542283) PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: A. 15A North Carolina Administrative Code 13B .0542(f)(2) states: “Except as provided in Subparagraph (4) of this Paragraph, the owners and operators of all C&DLF units shall cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and no less than once weekly. Cover shall be placed at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors. A notation of the date and time of the cover placement shall be recorded in the operating record as specified in Paragraph (n) of this Rule.” During the inspection, a large area of exposed waste was observed within the inactive portion of the landfill located northwest of the active working face. Therefore, Union County is in violation of 15A NCAC 13B .0542(f)(2) for failure to cover with six inches of earthen material as required. On February 15 & 16, 2022, Union County provided photographs by e-mail to the Solid Waste Section (see below). The photographs show that the exposed waste on the inactive portions of the landfill have been covered with soil. Therefore, this violation is considered resolved. Thank you for your cooperation in this matter. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 B. 15A North Carolina Administrative Code 13B .0542(n)(1)(F) states: “The owner and operator of a C&DLF unit shall record and retain at the facility or in an alternative location stated in the permit an operating record that shall contain the following information: (F) notation of date and time of placement of cover material.” During the inspection, it was determined that a cover log had not been kept up to date. Therefore, Union County is in violation of 15A NCAC 13B .0542(n)(1)(F) for failing to note the date and time of cover placement. To achieve compliance, Union County must ensure that a cover log is maintained as required. An inspection will be performed at a later date to evaluate compliance with this violation. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 ADDITIONAL COMMENTS 1. The facility consists of a closed MSWLF, a CDLF over a closed MSWLF, residential waste convenience area, yard waste area, recycling drop-off area, white goods/scrap metal area, tire collection area and a pesticide container building. 2. The facility is permitted to receive waste generated within Union County. 3. A gate is provided at the entrances to the facility to prevent unauthorized access. 4. Proper signage is located at the entrance of the facility. 5. All access roads were well maintained. Operations Inspection of the CDLF over closed MSWLF: 6. Observed operations of the CDLF. 7. No unacceptable waste streams were observed. 8. Edge of waste markers for the CDLF and closed MSWLF were being maintained. 9. Windblown waste was well controlled during the inspection. 10. Please refer to the document entitled “Approved Alternative Cover Materials for Use at Sanitary Landfills” dated May 6, 2019, for the use of spray-applied mortar coating as an approved alternative cover material. Operations Inspection of the Scrap Tire Area: 11. Tires were being collected in covered trailers and being stored properly. Operations Inspection of the White Goods Area: 12. White goods containing chlorofluorocarbons were being kept separate from other metals and were being stored in an upright condition. Operations Inspection of the Treatment and Processing Area 13. No unacceptable waste was observed. 14. Take measures to regrade the area to ensure positive drainage. Records Review: 15. Reviewed permit, operations plan, training records, tonnage records, groundwater and surface water monitoring reports, methane monitoring records, random load inspection records and compost temperature records. 16. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
