OBSERVED VIOLATIONS: None Long.:-80.099191 ° The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section ADDITIONAL COMMENTS: 1. All photos included in this report were taken by Susan Heim during the inspection on December 9, 2021. 2. The facility is permitted as an LCID landfill, a small Type 1 compost facility, and a treatment and processing facility for wood waste and used concrete. It is permitted to accept only land clearing debris, untreated wood, yard trash, and inert debris that is strictly limited to untreated/unpainted concrete, brick, concrete block, uncontaminated soil, rock, and gravel. 3. The landfill is currently operating in Phase 2, which Mr. Boyles estimated to be approximately 60% filled at the time of this inspection. Phase 3 is currently under construction. Please provide as -built drawings and a construction certification to Permit Engineer Ming-Tai Chao (ming.chao(n,ncdenr.gov) when construction of Phase 3 is completed so that an inspection can be scheduled prior to accepting waste in Phase 3. 4. The cured concrete treatment and processing area has not yet been constructed. Mr. Boyles stated that inert debris is being incorporated into the landfill at this time, and that he has no immediate plans to construct the pad and begin recovering concrete from incoming waste loads. If the concrete operations area is constructed, please contact the Solid Waste Section to schedule a pre -operations inspection of the area prior to starting concrete recovery and processing operations. 5. The facility appeared to be clean and well -maintained. Operations at the site were observed to be well managed. No windblown litter was noted, and no unacceptable waste was identified in the landfill or in the wood waste operations areas. 6. Unauthorized entry into the site is prevented by means of fencing, wood lines and berms, and the facility is secured by means of a locking gate at the entrance. Proper signage was observed at the facility entrance and informational signage was posted along the entrance drive. 7. Facility roadways are of all-weather construction and were found to be in good condition. An access roadway leading from the main parking area up the south side of the landfill to the tipping area appeared to be stable and in good condition, capable of accommodating landfill traffic and equipment. 8. Landfill operations are conducted from an office located at the end of the entrance drive, and incoming waste is tracked by volume as it arrives. Records are maintained in the office and are available for review upon request. Volume records for the period July 1 through December 9, 2021 were reviewed and found to be detailed and complete. 9. The facility maintains a cover log that lists the dates of each application of cover soil, slope repair, and seeding that takes place at the landfill. Information is first recorded on the office calendar then transferred to the logbook as a permanent record. The calendar was reviewed during this inspection and found to be very detailed and up to date. The calendar notations indicated that cover is applied more frequently than once per month, and that the entire landfill had received cover over the period from December 2 through 8, 2021. 10. An attendant is on duty during operating hours as required. The facility was operating during this inspection, and customers were observed dumping loads of brush and tree waste as instructed by the attendant. 11. All erosion control measures appeared to be functioning as designed, and no visible signs of erosion were noted. Mr. Boyles stated that he had been working with the city erosion control inspector to redesign the sediment basin, located at the northwest corner of the facility. The new basin was empty and dry at the time of this inspection. 12. Edge of waste markers were observed around the perimeter of the entire landfill as well as around the boundaries between landfill phases. Markers were spaced so that the perimeter of the fill area is easily discernable along each side of the landfill. 13. The working face was small and well contained. The tipping area is currently located on top of the Phase 1 fill area and appeared to be of adequate size to allow customers and facility staff to maneuver safely. 14. Progress had been made on the construction of Phase 3 since the previous inspection on March 23, 2021. Excavated slopes were observed to be in good condition, and soil had been stockpiled around the edge of the new phase. 15. A large portion of Phase 1 was covered with well established vegetation. However, Mr. Boyles noted that many areas that had been seeded during the fall were still bare, due in large part to the current drought. 16. The northern slope of the landfill had been pulled back and the grade had been reduced to allow cover to be Page 2 of 4 FACILITY COMPLIANCE INSPECTION REPORT NORTH D_E Q�� Division of Waste Management OewNnen�oi nvi—f E-ironmeMalOwllq Solid Waste Section applied and tracked into the slope more effectively, so that any surface water would sheet flow properly. 17. An emergency tipping area, designed during the fall following several periods of heavy rain events, had been constructed at the northeast corner of the active landfill area of used asphalt. A small load of cut logs and wood waste was observed on the slope in this area. Mr. Boyles stated that this waste had been dumped earlier in the week and would be moved to the working face when time permitted. 18. The wood waste processing area held two windrows of wood mulch. The windrows appeared to be well within the footprint of the wood waste operations area. Windrows were observed to be well maintained and were surrounded by fire lanes of adequate size to permit vehicular access for turning the piles and provide emergency access. Mr. Boyles stated that he turns the windrows frequently to prevent composting and to limit the potential for fire. Several hot spots were noted at the facility, and Mr. Boyles stated that facility staff identify and eliminate them quickly. 19. The compost operations area contained leaves that had been collected curbside by Town of Kernersville staff. Mr. Boyles stated that he had tracked the incoming leaf loads and stopped them prior to reaching the 6,000 cubic yards of compost set in the facility permit. He explained that the leaves had been brought to the facility during November, so no temperature readings had yet been recorded. 20. Logs are stockpiled along the southwestern end of the facility, where they are sorted and prepared for transport to a local sawmill for processing. Mr. Boyles pointed out a small firewood operation adjacent to the facility on the property to the east. He stated that he provides some of his logs to the neighbor for this purpose.
