Effective September 1, 1992, the Sanitation Department will be renamed the Solid Waste Management Department. This department will handle collection and disposal of solid waste and recyclables for the county. The address for this department will be 1600 North Main Street, Suite I-50, Waynesville, N. This past January a letter was mailed to all landfill owner/ operators informing them that the Solid Waste Section will be requiring semi-annual ground and surface water monitoring beginning January 1, 1993. All landfill owner/operators were requested to notify the Section prior to July 1, 1992, of the months they will be performing each of•their semi-annual sampling episodes for the 1993 calendar year. Please note details in the letter of January 10, 1992 that is enclosed with this letter. As of this date the Solid Waste Section has no record of the proposed sampling dates for next year for your facility. Please notify the Solid Waste Section in writing immediately of the two months you have -chosen for sampling this coming year. A response should be received in our office by October 15, 1992. If you have any questions regarding this request or the water quality monitoring program required at sanitary landfills in North Carolina, please contact the -Solid Waste Section at (919) 733-0692. Lawerence Tannery Property Dear Mr. Wrenn: The Solid Waste Management Division has received a request for characterization of the subject waste. Based upon the submitted information, the waste appears to be non -hazardous. The Solid Waste Management Division has no objection to the sanitary landfill disposal of this waste, if in accordance with the conditions listed below: 1. The owner/operator of the landfill approves the disposal. 2. The waste contains no free liquids and can be confined, compacted, and covered in accordance with the Solid Waste Management Rules (15A NCAC 13B). 3. Approval for sanitary landfill disposal is explicitly limited to a "one-time" basis. Further approval by this office will require submittal of a new Waste Determination form, and (if applicable), new analytical data. Failure to meet these conditions may result in revocation of this approval, and subsequently, an administrative penalty. If you have further questions or comments concerning this matter, please contact this office at (919) 733-0692. Please note that this approval is being made even though selenium waste analyzed to be <0.05 ppm leachable only and not shown to be <0.1 ppm which is the NC Landfill Limit. Lawrence Tannery Property Dear Mr. Wrenn: General Statute 130A-294 authorizes the Solid Waste Management Division to regulate solid waste management in North Carolina. It, therefore, gives authority to the Division to evaluate wastes that may pose a threat to the environment or to public health and to subsequently prohibit disposal of these wastes at a sanitary landfill in accordance with Sections .0103(d) and (e) of the Solid Waste Management Rules, 15A N.C.A.C. 13B. Your recent request for disposal of the subject waste has been reviewed and evaluated by section personnel. It cannot be determined if the subject waste is suitable for landfill disposal at the designated landfill due to the absence of adequate data. For this reason your request is denied. It is recommended that the waste be disposed in a secure site even though the test analyses supplied does prove the soil is non -hazardous. At minimum, a complete TCLP analysis would need to be performed at an estimated cost of $1,200 - $1,500 and a paint filter test would have to be made costing perhaps $25 - $75. The recommended disposal should be more cost effective considering the very small volume of waste involved. Please note that the data submitted on this waste was for "totals" on the organic constituents and did not include herbicides, pesticides nor for the the RCRA metals. The waste contains no free liquids and can be confined, compacted, and covered in accordance with the Solid Waste Management Rules (15A NCAC 13B). 3. Approval for sanitary landfill disposal is explicitly limited to a "one-time" basis. Further approval by this office will require submittal of a new Waste Determination form, and (if applicable), new analytical data. Failure to meet these conditions may result in revocation of this approval, and subsequently, an administrative penalty.
