STATUS OF PAST NOTED VIOLATIONS:
1. 15A NCAC 13B .1627 (d)(1) – RESOLVED - Corrective Actions to cap needed during closure.

In regards to the previous violation, with the breach of the cap system on the closed MSW landfill by C&D landfill operations, Cumberland County should move forward with planning and budgeting for such upgrades to previously submitted and approved closure plans, including any required adjustments for financial assurance, etc. Revised and final closure plans should be submitted for review if not done so already. ADDITIONAL COMMENTS
1. Amanda Thompson and David Powell, with the Section, met with Amanda Bader, Mike Renfro and Neil Cunnington with Cumberland County Solid Waste (CCSW) to inspect the Cumberland County landfills. A
second entrance with weigh station is being built to allow for increased traffic into and out of the LF.

2. Records reviewed included: monthly waste analysis, waste cover records, scrap tire certification forms, waste screening reports, daily inspection reports, leachate sampling data, environmental monitoring reports for groundwater and methane, asbestos manifest/weight ticket documentation, certified operator certificates. Three staff member have SWANAs’ Landfill Management certification and AAA Environmentals’ AHERA Supervisor
Initial Training Course certificates for asbestos.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

3. County staff indicated, when asked about any groundwater issues, that levels for 1, 4 dioxane, and previously dichlorobenzene, were elevated, and they were working with Elizabeth Werner, Hydrogeologist with the Section, and had submitted a plan to monitor. Continue to report and follow her guidance. 4. Last inspection, there were problems with MW’s having id’s, lids and locks. Ms. Bader shared some notes for shortly after that inspection showing repairs. MWGP-5 is south of the CDLF working face and closed MSW, on south side of perimeter road, and was one of those. It was checked and it didn’t have a lid this visit either. Upon
inspection, it was discovered that the lid had been knocked off recently by bush hogging. A photo was sent via 11/12/2021 of the lid repaired and locked. Later during records reviewing it was discovered this well had very high methane concentrations in recent couple years, and was over the 25% of the LEL for methane. Cumberland
County should forward this information to Elizabeth Werner, Hydrogeologist with Section, and follow her guidance on those issues. Other MW’s, such as GW MW-1, MW-J, MW-K, M-2, and Methane MW-1 were inspected and were locked with identification.

GP5 – 7/22/2021 Methane 53.40 % by volume. 4/16/2021 it was 53.20%.
5. A convenience site is located beside the scale house, which accepts, scrap tires, scrap metal, recycling of glass, aluminum, electronics and cardboard. Glass has a place outside the building. Scrap tire collection is done by Central Carolina Holdings, in Sanford NC. Three trailers for tire collection onsite. Tire certifications records were viewed. White goods are removed by county staff, Virgilio Serna EPA certification issued 8/14/2020 was viewed. 6. Cardboard is stored and collected inside big building behind office and beside scale house. Loose cardboard taken to Pratt in Fayetteville, NC, baled cardboard goes to Sonoco also in Fayetteville. Paper is shredded on Tuesdays. Electronics are taken, once palletized, to recycler in Synergy in Madison, NC. There are also roll offs for scrap
metal, furniture, some simple C and D, and garbage. The County separates burned items and requires documentation/burn permit that fire is extinguished 11 days or greater and no coals are brought in which may be a
hazard. Used oil can be taken here as well and a company named “Noble” removes it. 7. Shingles were stockpiled onsite last inspection beyond convenience site. The County intended to use the stockpiled
shingles for assisting in rebuilding a haul road to Wilkes Road Site. This plan was not approved by Solid Waste Section. Those shingles have now been recycled into asphalt through Barnhill and some have been used in a road for CDLF across closed MSW. Some waste was outside EOW markers and needs to be brought back inside EOW. Just across access road from this shingle road is a new pad being constructed, beside concrete crushing. Its graded and ready for concrete to be poured with concrete block borders. It will be where asphalt shingles will be stored and accepted.

8. Facility has new flare and skid blower. Repairs/installation still being done currently. Cargill is still getting gas from landfill.

9. Concrete crushing area doesn’t have a lot of concrete waiting to be crushed. Good job.

10. Leachate pond level was very low. It is still being conveyed through a collection system, controlled by valves, and frequently turned on to allow for the leachate to go to the local WWTP.
11. Working face was not too large with cover being stockpiled nearby. Currently working in Phase 6. Dust was not an issue during the inspection. County staff indicated that they were using a water truck periodically to address dust as needed along the roads. Good job.

12. Some areas around perimeter have been repaired. Good job. Soil has been replaced and vegetation is growing in some of the repairs. Be diligent in watching for erosion in these areas. Landfills were being mowed. EOW markers were easily visible in most areas around the perimeter but site could use more frequent mowing. 13. A new area, in SE corner of the parcel, for taking composted vegetative waste and soil to mix for 50/50 mix ADC has been established. Soil and the compost are poured onto ground and spread out together. Then loaded up and taken to the landfill working faces. A good comingling of the soil and compost is done through the unloading, loading and movement of the material. Site does seem to be larger than one acre, so be sure
DEMLR requirements are satisfied.

there is a lot of windblown/exposed waste. Either it is windblown and should be picked up and put into working face to be covered or it is exposed waste and those areas need the proper cover. Please address.

15. The NW side of site, the Closed MSW, looked good. EOW markers were visible and site was not overgrown. Roadway was in good condition. No settled or seeping areas were visible.
16. Cumberland County Solid Waste has new equipment in the form of an excavator, bulldozer (coming soon), and are fixing a current compactor. Still have four as back up compactors. Some of this equipment is shared with Wilkes Rd. Compost site at times.
17. Corrective measures are necessary as result of this inspection. A follow up inspection will be conducted by Solid Waste Section Staff in about 30 days. Failure to meet the conditions for compliance may result in Compliance Actions.
