Box 489, Laurinburg, NC 28353 PARTICIPANTS: David Powell, NC DEQ – Solid Waste Section Bill Lash, Scotland County Landfill Supervisor STATUS OF PERMIT: 8301-CDLF-1997 - Life of Site Permit to Operate Expires December 31, 2057 8301-MSWLF-1980 - Closed PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: Permit Attachment 3, Part VII, (22) - UNRESOLVED OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. CDLF facility is currently operating in Phase IV (on top of closed unlined MSWLF – Phase II). Includes post- closure care requirements for the closed MSWLF Phase I, II, and III (under Phase IV CDLF) as well as, concrete stockpile areas, mobile home deconstruction area and 2-acre yard waste storage and processing area. 2. UNRESOLVED - Permit Attachment 3, Part VII, (22) - The area that is encompassing approximately two (2) acres and located at the northwest end of the landfill facility is permitted to operate a treatment and processing facility as defined in Rule 15A NCAC 13B .0101(49). Currently a company was onsite grinding the yard waste (YW). This waste, after mulching, was being staged in one big windrow just east of the grinding area. Some of the waste is separated to be used as boiler fuel at Bennettsville, SC. City of Laurinburg is currently bringing most of their yard waste/trash here as well. The County has made considerable progress with a large amount of the older waste being utilized as 50/50 mix ADC cover at the CDLF working face or for erosion control on the closed MSW landfill. However, there is much more to address with this area. During the inspection, Mr. Lash and Mr. Powell discussed working first on removing the older YW near or inside property line buffers of 50 feet and swale/ditch buffers of 25 feet. Some of the berms surrounding the processing area may be of older composted YW but it is still considered waste and should also be removed to meet these guidelines. All YW should be stored at a max height of 15 feet, width of 50 feet, at any time. Some piles were higher than 15ft and need addressing. Be sure new windrows meet these criteria with fire breaks. Refer to Permit Attachment 3, Part VII, (22). Site is still using more than the approved two acres and a total of 4,000 tons annually. Edge of Waste (EOW) markers should be installed, suggest large tall white PVC pipe, to outline the approved area with respect to the proper buffering from property lines, buffers, etc. All treatment and processing of yard waste activities should then be carried out inside the approved footprint. The mulch being used on the closed MSW is being staged, raked and screened to a maximum thickness of 3 inches. Unapproved wastes should be removed and disposed of at appropriate landfill. The County has been able to utilize a lot of the older YW, but if Scotland County cannot catch up and manage according to rule/permit then ceasing accepting Laurinburg’s waste, permit modifications or other avenues of disposal should be considered. Mr. Powel and Mr. Lash discussed an additional 60 days to address the YW onsite. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 8 Mulching newer YW. During last inspection, several gas and water wells seemed to have same registration ID, some were unlocked or damaged and some possible not constructed to correct standards. Mr. Lash informed Mr. Powell that they had been fixed, with correct numbers, locks, plates and repaired if needed. Although not all were visited and inspected during this date, many were, including GP1, GP2, GP3, MW6, and MW5. The waste type observed was correct at the time of inspection. Soil and mulch was staged for 50/50 mix ADC. Cover looked good as well. Working face CDLF. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 6 of 8 5. Small amount of water from very recent rain was observed near working face on CDLF. This had been addressed, as requested, with soil added and good grading, but the water shown was from previous night. Continue to monitor areas like this as working face moves around the CLDF. Good job. Working face out of frame far right. 6. A 20-foot cargo container was being used off to the side of working face of CDLF for storage of a mini excavator. This has now been removed from the landfill working face and is stored near perimeter fence line on other side of access road. Good job. During last visit, a small amount of unacceptable waste (painted block) was observed mixed in with the clean concrete and has not been removed. Current quantity onsite is less than the approved max volume of 10,000 cubic yards, but the material is spread out. Permittee must maintain a stockpile of inert debris with the dimensions no more than 150 feet by 150 feet by 25 feet high. Discussion with Mr. Lash estimated that the quantity onsite s about 50% of the way before County can get someone to come and crush. Rule Reference: § 130A-309.05. Regulated wastes; certain exclusions. Basically says 75% of what concrete is taken must be utilized/crushed within a year. Concrete storage area. 8. Mobile Home Deconstruction area had a new mobile home for deconstruction, dated 10/22/2021. MH deconstruction area. Shrubs along backside of the closed MSW/CDLF, bear Transfer Station were also removed as requested. Good job. 10. Corrective measures are necessary as result of this inspection. A follow up inspection will be conducted by Solid Waste Section Staff in about 60 days. Mr. Powell is willing to continue working with the Scotland County, just please communicate well and make progress towards fixing the issues onsite quickly. Due to the nature of some of the violations, additional time may be needed for correcting the violations. Scotland County should has made measureable progress but more is needed in the Treating and Processing of yard waste area. Additional follow ups may be needed. Failure to meet the conditions for compliance may result in Compliance Actions.
