However, the landfill facility will continue to be used as a collection site for solid waste generated by the University. The solid waste will be collected in 40 cubic yard containers rented from and hauled away by a solid waste collector. A closure plan is being developed by Jensen Engineering and will include the siting of a convenience facility for placement of 40 cubic yard containers for deposit of University generated wastes. As an interim, we request temporary approval to continue use of the landfill facility for a waste management activity. The following information is provided in accordance with DEHNR memo updated August 1, 1993, page 5: A. The solid waste is generated by activities in administrative, academic, dormitory and cafeteria facilities. It also includes litter that is collected around the campus. The collected waste will be disposed of at a permitted MSWLF. A request for proposals will be opened on October 1, 1993. We anticipate the contract hauler will utilize Jackson County's landfill. B. The location of the convenience facility is shown on the attached plan. C. No other waste management activities are planned for the landfill facility. Recycling/product separation is accomplished at the source. The convenience facility is located in the borrow area, well clear of the disposal area and will not interfere with closure or post -closure activities of the MSWLF. The proposed North Carolina Solid Waste Management Rules reflect significant changes for ground -water monitoring based on requirements of the E.P.A. Subtitle D Rules. Attachment A to this letter provides a summary of important dates and significant activities that must be accomplished in order to be in compliance with the new rules. Attachment B contrasts existing and proposed ground -water monitoring and assessment requirements based on changes in the rules. Because of significant increases in costs that will be incurred in order to operate a MSWLF under the new Subtitle D Rules, including financial assurance and increased costs for ground -water monitoring and assessment, you may wish to seriously consider closing your sanitary landfill prior to October 9,1993, when the new rules become effective. When the new rules take effect, MSWLF facilities that have violations of the North Carolina Groundwater Quality Standards or facilities that show a significant statistical increase in the level of any Appendix I constituent will quickly be required to implement assessment monitoring for all Appendix II constituents. Since the Groundwater Quality Standards are also used in establishing the ground -water protection standards, MSWLF facilities with violations may also rapidly move into assessment of corrective action alternatives based on a full-scale ground -water investigation to determine the nature and extent of contamination at the site. Dear Mr. Brookhart: I have visited the Western Carolina University Water Treatment Plant and inspected the sludge generated from the sludge dewatering system. This sludge is not dry enough as it comes out of the system to place directly into a sanitary landfill. All sludges must pass the "Paint Filter Test" before they can be landfilled. As a matter of policy, the Solid Waste Section does not require a waste determination be completed for alum sludges from water treatment plants; therefore, no analysis of the sludge will be required other than the paint filter test mentioned above. The Section hereby grants approval, with the attached conditions, for the construction and operation of a temporary transfer facility at the University landfill. This approval is effective for six (6) months from the date of construction completion (see Condition Number 3). If the University wishes to operate a transfer facility on a permanent basis, it will be necessary to obtain a permit from the Section. Please note conditions No. 4 and 5 which establish the pre -operational requirements and operational conditions for the site. The waste management specialist for this facility must be contacted for a pre -operational consultation. This facility is hereby approved to receive solid waste as defined in 15A NCAC 13B .0101 (36), except that hazardous and liquid wastes are prohibited from acceptance at this facility. M This facility shall only receive solid waste that is generated on the campus of Western Carolina University, as described in the request for a temporary transfer facility, and shall be disposed of at the Jackson County Landfill, Permit #50-02. 3. This approval shall be in effect for six (6) months from the date of construction completion. 4. The following requirements shall be met prior to receiving solid waste at the site: a. A consultation shall be made with a representative of the Solid Waste Section prior to actual waste transfer. b. The words "No hazardous or liquid wastes accepted" shall be posted on an entrance sign. 5. Operation of the facility shall occur in accordance with 15A NCAC 13B .0402, "Operational Requirements for Transfer Facilities", the operational plan submitted to the Solid Waste Section, and these additional requirements: a. This facility shall be operated in a manner which is consistent with the state solid waste management plan and with the solid waste management plans that have been adopted by those units of local government served by the facility and approved by the Section. b. On I or before 1 December 1993 and each year thereafter, the owner or operator shall report to the North Carolina Solid Waste Section, for the previous year beginning 1 July and ending 30 June, the amount by weight of the solid waste that was received at the facility and disposed of in a landfill, incinerated, or converted to fuel. To the maximum extent practicable, such reports shall indicate by weight the county of origin of all solid waste.
