Closure Inspection at Old Tire Disposal Area Located on the Bank Below Western Carolina University Disposal Area. I inspected the old Jackson County Landfill site located on SR 1336 near Cu llowhee on September 12, 1990, for proper closure. The disposal area is immediately in back of the disposal area presently being operated by Western Carolina University. I found the old disposal area to be covered with 2 feet or more soil and stabilized with grass. The tire disposal area located down gradient from the Western Carolina University disposal area was also properly closed out and stabilized with vegetation. The small stream at the bottom of the tire disposal area has been relocated, so as to keep separated from water. Western Carolina University has done an excellent job closing out the tire site. The permit #50-01 which was originally assigned to Jackson County has been transferred to Western Carolina University. This is the permit number Western Carolina is currently operating under, so we need to make sure only the old Jackson County area is specified as being closed out. Please let me know if further information is needed. (1) PLAN AND PERMIT REQUIREMENTS (a) Construction plans shall be approved and followed. (b) Specified monitoring and reporting requirements shall be met. (2) SPREADING AND COMPACTING REQUIREMENTS (a) Solid waste shall be restricted into the smallest area feasible. (b) Solid waste shall be compacted as densely as practical into cells. (3) COVER REQUIREMENTS (a) Solid waste shall be covered after each day of operation, with a compacted layer of at least six inches of suitable cover or as specified by the division. — (b) Areas which will not have additional wastes placed on them for 12 months or more shall be covered with a minimum of one foot of intermediate cover. —(c) After final termination of disposal operations at the site or a major part thereof or upon revocation of a permit, the area shall be covered with at least two feet of suitable compacted earth. (4) EROSION CONTROL REQUIREMENTS (a) Adequate erosion control measures shall be practiced to pre- vent silt from leaving the site. (b) Adequate erosion control measures shall be practiced to pre- vent excessive on -site erosion. (5) DRAINAGE CONTROL REQUIREMENTS — (a) Surface water shall be diverted from the operational area. (b) Surface water shall not be impounded over or in waste. (c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS — (a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. (b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS (a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. (b) Solid waste shall not be disposed of in water. — (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (10) SAFETY REQUIREMENTS (a) Open burning of solid waste is prohibited. — (b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. (e) Barrels and d ru ms shall not be disposed of unless they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. — (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. — (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1,1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. Rowe Division Director Pursuant to N.C.G.S. 130A-22(a) and to 10 NCAD 10G, I conducted an inspection on May 22, 1990 of the Western Carolina University Landfill, Permit #50-01, located in Jackson County on State Road 1336 near Cullowhee, North Carolina. The inspection found the Western Carolina University Landfill to be in violation of certain requirements contained the North Carolina Solid Waste Management Rules, codified at 10 NCAC 10G specifically: 1. 10 NCAC 10G.0505(1)(a) requires that construction plans shall be approved and followed. The Western Carolina University Landfill was operating in violation of 10 NCAC 10G.0505(1)(a) in that final elevations for the waste disposal area as indicated on the approved landfill, construction plans have been exceeded. An Equal Upportuniry Affirmative Action Fmrloyer COMPLIANCE SCHEDULE Based upon the foregoing, Western Carolina University is hereby ordered to take the following actions by July 2, 1990 to correct all violations as stated in this Notice of Violation and otherwise be in compliance with the North Carolina Solid Waste Management Rules, codified at 10 NCAC 10G: 1. Comply with 10 NCAC 10G.0505(1)(a) by submitting for approval to the permitting staff of the Solid Waste Management Section a complete application to vertically expand the waste disposal area at the Western Carolina University Landfill. If the requirements above are not met on a continuing basis, enforcement action may be taken. Remedies include assessment of Administrative Penalties of up to $5,000.00 per day per violation, dating from the compliance date in this order, and/or injunctive relief pursuant to N.C.G.S. 130A-22 or N.C.G.S. 130A-18. (1) PLAN AND PERMIT REQUIREMENTS (a) Construction plans shall be approved and followed. I (b) Specified monitoring and reporting requirements shall be met. (2) SPREADING AND COMPACTING REQUIREMENTS — (a) Solid waste shall be restricted into the smallest area feasible. (b) Solid waste shall be compacted as densely as practical into cells. (3) COVER REQUIREMENTS (a) Solid waste shall be covered after each day of operation, with a compacted layer of at least six inches of suitable cover or as specified by the division. (b) Areas which will not have additional wastes placed on them for 12 months or more shall be covered with a minimum of one foot of intermediate cover. (c) After final termination of disposal operations at the site or a major part thereof or upon revocation of a permit, the area shall be covered with at least two feet of suitable compacted earth. (4) EROSION CONTROL REQUIREMENTS (a) Adequate erosion control measures shall be practiced to pre- vent silt from leaving the site.( (b) Adequate erosion control measures shall be practiced to pre- vent excessive on -site erosion. (5) DRAINAGE CONTROL REQUIREMENTS -- (a) Surface water shall be diverted from the operational area. (b) Surface water shall not be impounded over or in waste. (c) Completed areas shall be adequately sloped to allow surface water runoff in a controlled manner. (6) VEGETATION REQUIREMENTS (a) Within six months after final termination of disposal operations at the site on a major part thereof or upon revocation of a permit, the area shall be stabilized with native grasses. (b) Temporary seeding will be utilized as necessary to stabilize the site. (7) WATER PROTECTION REQUIREMENTS —(a) The separation distance of four (4) feet between waste and water table shall be maintained unless otherwise specified by the division in the permit. (b) Solid waste shall not be disposed of in water. (c) Leachate shall be contained on site or properly treated prior to discharge. An NPDES permit may be required prior to the dis- charge of leachate to surface waters. (9) SIGN REQUIREMENTS (a) Signs providing information on dumping procedures, the hours during which the site is open for public use, the permit number and other pertinent information shall be posted at the site entrance.- - (b) Signs shall be posted stating that no hazardous or liquid waste can be received without written permission from the division. — (c) Traffic signs or markers shall be provided as necessary to pro- mote an orderly traffic pattern to and from the discharge area and to maintain efficient operating conditions. (10) SAFETY REQUIREMENTS — (a) Open burning of solid waste is prohibited. (b) Equipment shall be provided to control accidental fires or arrangements shall be made with the local fire protection agency to immediately provide fire -fighting services when needed. (c) Fires that occur at a sanitary landfill shall be reported to the division within 24 hours and a written notification shall be submitted within 15 days. — (d) The removal of solid waste from a sanitary landfill is prohibited unless the owner/operator approves and the removal is not performed on the working face. —(e) Barrels and dru ms shall not be disposed of un less they are empty and perforated sufficiently to ensure that no liquid or hazard- ous waste is contained therein. (11) WASTE ACCEPTANCE AND DISPOSAL REQUIREMENTS — (a) A site shall only accept those solid wastes which it is permitted to receive. — (b) No hazardous, liquid, or infectious waste shall be accepted or disposed of in a sanitary landfill except as may be approved by the division. — (c) Spoiled foods, animal carcasses, abattoir waste, hatchery waste, and other animal waste delivered to the disposal site shall be covered immediately. — (d) Asbestos waste that is packaged in accordance with 40 CFR 61, as amended through January 1,1985, may be disposed of separate and apart from other solid wastes at the bottom of the working face or in an area not contiguous with other disposal areas, in either case, in virgin soil. Separate areas shall be clearly marked so that asbestos is not exposed by future land -disturbing activi- ties. The waste shall be covered immediately with soil in a manner that will not cause airborne conditions. This facility shall conform to operating procedures in Rule .0505 of the Solid Waste Management Rules, and the conditions specified herein. 4. Western Carolina University shall submit remolded sample cover data in accordance with .0504 (1) (c) (F) of the Solid Waste Management Rules with the next 1990 ground and surface monitoring reports. 5. A closure and post -closure plan must be submitted for approval at least 90 days prior to closure or partial closure. The plan must include all steps and measures necessary to close and maintain the facility in accordance with all rules in effect at that time. The University is responsible for the operati..: n and maintenance of the site. The landfill currently owns and operates one tracked loader and asheeps footr_oller. Properly maintained, this machinery_ is adequate to operate this vertically expanded landfill site. It is estimated that from the proposed landfill and borrow area 13,540 cubic yards of borrow material will be required to process 17,960 cubic yards of waste including final cover. This is based upon 3:1 trash to fill ratio. The volume of borrow is sufficient for the estimated life of the landfill. Assuming 2,700 cubic yards of trash material handled per year, the landfill can be expected to operate 5.0 years before reaching completion. The method of orderly operation and development of the landfill is as follows: 1. Clean existing silt basins. 2. Perform temporary seeding on all denuded areas except for immediate work ar! � s . 3. Construct proposed riprap drains to preset level. 4. Commence fill operation of cells beginning at toe of present operation and working upward. Completed work areas shall receive temporary seeding as they are closed out. 5. Install additional riprap for drainage when level of landfill reaches terraced areas and lower work areas are closed out. Slope terraced areas to drain to riprap drains. Keep equipment away from closed out areas to prevent damage to slope drains. 6. Maintain all erosion control devices, both new and existing during construction and operation of the landfill. 7. At closeout of landfill provide 2 foot compacted cover and seed all bare areas.
