Dear Mr. Strickland:
The purpose of this letter is to apprise you of the current status of various
actions relating to the operation of the referenced landfill.
In coordination with the appropriate Jackson County officials, we closed the
public operation of the landfill on July 31, 1984. No further refuse, other
than that generated by the University, is being delivered to the landfill.
The University, for a limited time and pending approval of a new operational plan,
will continue to use a small portion of the active area for its refuse only as
authorized by your letter of May 14, 1984. The remainder of the active area is
being regraded to assure both adequate coverage and proper drainage until a final
close out plan is implemented.
Butler Associates of Asheville, our engineering consultant, is currently nearing
completion of the proposed plan for continued operation of the landfill by the
University. We anticipate that the plan can be submitted to you for review and
approval by the end of this month. Included with the operational plan will be
a formal plan for the final close out of the now active area of the landfill.
We appreciate your assistance in working with us on this matter. If there are
any questions on the present status, please do not hesitate to contact me.

Dear Mr. Cabe:
Lnspections were made on January 30, 1984 and July 16, 1984 at
the Jackson County Landfill in Cullowhee. This letter is to notify
you that the following violation of the NORTH CAROLINA SOLID WASTE
MANAGEI`= RULES was recorded on these two consecutive inspections:
Six inches daily cover required
DHS Rule .0505
The six inches of cover material (soil) should be placed over
the refuse consistently and daily. A reinspection of the landfill
will be conducted during the next thirty days and any remaining
or new violations will be noted.
Any violations of the SOLID WASTE MANAGEMENT RULES are subject
to administrative action pursuant to G. S. 130-166.21E.

Dear Mr. Carter:
After carefully reviewing your request to utilize part of the old
disposal site for the placing of additional waste, we made the
following decisions:
1. The existing operation (beige area) be closed out in
accordance with the rules as soon as a plan is approved
for the brown area.
2. The brown area which has been used as a landfill be
planned for the University waste only so that an addi-
tional six-foot lift can be placed over the existing
waste. Cover material will be needed from other areas
and should be shown in the plan.
3. A groundwater monitoring well be placed between existing
waste and house "E" as shown on the plan. It is recom-
mended that the University purchase house "E," if possible.
The areas in blue and gray are not suitable for use as proposed due
to topographic limitations and potential for contamination of down -
gradient drinking water supplies.

Dear Mr. Strickland:
In response to your letter of January 19, 1984, concerning
our present landfill facility, we hereby request an
i extension of 60 days in which to appeal the mandated
close-out. This time is needed to investigate several
alternatives presently being considered. They include
1. moving the landfill operation to the north end of the
existing property,
2. acquiring adjacent structures to expand the buffer
area within 50 feet of the west property line,
3. acquiring adjacent structures and land to the west to
better utilize the existing property,
4. moving the landfill to a new site,
5. investigating the economics of transporting the
University's waste to the County landfill at
Dillsboro.
We have asked the engineering firm of Butler/McGill
Associates to begin investigating these alternatives. We
would like to reserve our right to an administrative hearing
if the usefulness of such is indicated by Butler/McGill's
findings.
Pending completion of this further study, it is the
University's intention to continue utilizing the present

property or a portion thereof for landfill, subject to the

provided such future use can be _shown to meet the
requirements of the North Carolina Solid Waste Management
rules.
Your favorable consideration of this request will be greatly
appreciated.

Re: WCU Landfill (50-01), Jackson County
Recently, Mr. Randy Turner has contacted this office in regard to
questions concerning the operation and permit requirements of the referenced
landfill.
Members of my staff have made site visits and reviewed the 1974 permit
application. The field evaluation and review of existing data have produced
the following conclusions:
1. The landfill has exceeded the operational limits that were imposed
during the closeout approval.
2. The landfill violates requirements per Section .0503(2)(f)(ii) of
the current Solid Waste Management Rules which requires a 500-foot
buffer between private dwellings and wells and disposal areas.
For the above two reasons, it has been determined that a permit renewal
or plan modification for this site cannot be made. Furthermore, that the
site will have to be closed out in accordance with Sections .0505 and .0510
of the Solid Waste Management Rules.
I have taken into consideration that there is presently another existing
landfill in the county which can be utilized. Therefore, the date to
terminate disposal operations at the site is set for no later than August 1,
1984. Final closeout per Section .0510 is set for no later than November 1,
1984, or three months after termination of disposal operations.
You may appeal this decision within thirty days after you receive this
notification by requesting an administrative hearing concerning this matter.
The request must be submitted in writing and must state the legal and factual
issues in dispute. When a hearing is requested, it shall be in accordance
with the rules contained in 10 NCAC 1B .0200, a copy of which is enclosed.
